Mayor Herkner advised Mr. Korman that this communication had been read at the <br />last Council meeting. <br />Mr. Korman stated he had been working on this problem <br />for some time in trying to ascertain where responsi- <br />bility lay for maintaining this parking lot as he felt <br />serious law suits could result from hazardous conditions. <br />He stated he had been informed by City Manager he would <br />be agreeable to recommending holes be filled in the lot, <br />but that City Attorney had stated City should get per- <br />mission from the Southern Pacific to do so. <br />37 <br />Mayor Herkner questioned whether lease was held by the City on this parking lot <br />and was advised by the City Attorney of leases covering the Perry Street parking <br />spaces, and for certain portions of streets surrounding this parking lot, but <br />that no lease existed on this lot. <br />Mr. Korman stated he had been informed by Southern <br />Pacific one week that they would pave the area, and <br />then had since been adSis�d& they had changed their <br />minds as they had other plans for the property. <br />Mr. V. A. Wolfe, representative of Southern Pacific, <br />2864 Briarfeld, stated City Attorney was correct on <br />leases as stated, and no lease covered the property in <br />question. <br />Councilman Keckley questioned whether Southern Pacific would consider surfacing <br />the parking lot, <br />Mr. Wolfe advised property referred to quite valuable and <br />they were interested in finding a proper developer but <br />felt Company would surely consider some interim measure <br />by the City. <br />Councilman Bury questioned proposal for parking by commuters if this property <br />was developed to another use. <br />Mr. Wolfe advised commuters would be certain to find <br />parking space available elsewhere as he had noticed <br />not all metered parking spaces in use in adjacent areas. <br />City Attorney asked if a reasonable determination could be made of what parking <br />requirements would be considered appropriate to require Southern Pacific to fur- <br />nish parking spaces, like any other business, what position would be taken by <br />their Company. <br />Mr, Wolfe replied their Company did not furnish any <br />parking facilities for commuters but in any event this <br />issue would have to go before the PUC - <br />Councilman Henderson questioned type of lease available and how expensive it <br />would be to fill the chuckholes in the parking lot. Mayor Herkner asked if a <br />thirty day lease would justify City filling chuckholes. City Manager stated he <br />had checked on costs of improving this parking lot, but that City Attorney had <br />advised public monies could not be spent to improve private property when not <br />even a lease held on the property, and that besides Southern Pacific had speci- <br />fically stated their position as to their not being obligated to provide parking <br />for commuters. <br />He stated that in discussing this matter with Mr. Wolfe, it had been indicated <br />however, that a short term lease arragnement could be worked out whereby City <br />would be permitted to correct deficiencies in the lot for the benefit of the <br />citizens of the community. He advised costs on improving lot would amount to <br />OR 24 'BT <br />
