actions possible under Subdivision Ordinance and possibility of requiring dedi- <br />cation of ingress and egress easement on which City could control parking or <br />force removal of obstacles. He advised no improvement agreement under considera- <br />tion at this point as no Final Map yet submitted, but which could contain con- <br />trols thought necessary. <br />Councilman Granger expressed his concern for access proposed and questioned why <br />property owner didn't make a proper street as felt plan submitted would never <br />qualify for any sort of financing for its development. <br />Stan Kangas, of Lawrence Brian's firm, representing appli- <br />cant, explained number of different schemes that had been <br />attempted for subdividing property both with a dedicated street <br />and even a cul-de-sac, and that proposal now made resulted <br />from a compromise with City Staff, as original plan had only <br />included the one 25' strip for access to rear parcel. He <br />stated applicant didn't wish to make a public street dedica- <br />tion, but was willing to make a public emergency easement so <br />parking and other uses would be prohibited. <br />Police Chief advised it would not be possible to enforce parking restrictions <br />on a private easement. Councilman Rosselli felt consideration for granting of <br />exception should be given in this particular case because of applicant having <br />been urged to annex and felt controls had been indicated which would assure <br />City protection, and which would result in this development being a stepping <br />stone towards better development of the whole area. <br />City Attorney advised of the further conditions that could be added to the Reso- <br />lution granting the exception. Councilman Henderson favored deferring action on <br />this matter as best serving all interests, to have Planning Commission realign <br />the lots. Councilman Petersen questioned possibility of consolidating the two <br />easements, making possible a single wider access to rear parcel, and agreed to <br />continuance if this suggestion would be considered. <br />Mr. Kangas advised he would have to consult with the <br />property owner on this proposal. <br />The possibility of dedicating the access strip as a public alley was discussed. <br />Councilman Rosselli felt this matter had been worked out with Staff and best <br />solution had been recommended by Staff and should be approved, if further controls <br />as had been suggested be added. City Manager recommended that City not request <br />dedication of easement as a public alley which would require maintenance by City, <br />but that other controls be worked out agreeable to the City Attorney which would <br />protect access, for emergency purposes. <br />Councilman Bury asked whether motion to grant exception also included requirement <br />for clearing site and Councilman Rosselli asked this be included in his motion to <br />grant the exception. Councilman Henderson moved to table this matter. Motion <br />lost for lack of a second. <br />Mr. Kangas questioned proposal recommended concerning <br />clearing of site and assured Council of intentions of <br />property owner to clear property as soon as possible, but <br />admitted reluctance to be limited to a definite date as buildings <br />referred to now on site did produce income and helped pay the <br />taxes on the property. <br />0 1 IT <br />49 <br />
