r - 5 <br />Director of Public Works advised Ordinance stated unless weeds were abated by <br />the time contract crews arrive at such property to abate weeds, then weeds are <br />automatically abated at that time. Mr. Boicelli was asked to check with the <br />Director of Public Works as to status of his property on weed abatement. Motion <br />carried on roll call vote. <br />Application of Charles R. Brenton, 1121 Edgewood Rd., for sewer connection to his <br />property at 1351 Edgewood Road presented for consideration. Staff recommended <br />denial of application because no hardship involved and no structures on the <br />property at present. Slide was shown of the three parcels of property involved, <br />being outside City limits. <br />Mr. Brenton, applicant, reported he held option on the <br />two parcels of property owned by Mr. Michael Thomann, <br />third parcel also owned by Mr. Thomann containing a rental unit <br />for which taxes and income on the whole of the property <br />did not make the payments on the property, hence his <br />desire to sell the two lot portion. <br />Mr. Brenton advised he had contacted County concerning <br />building and had been advised he must either acquire <br />Redwood City sewer connection or from the Sewer District, <br />but that the subdivision of the lots as depicted, with <br />access to two lots in rear from an access easement and <br />partial cul-de-sac bulb at rear, had been approved by <br />the County. He felt a hardship did exist for Mr. Thomann <br />and urged sewer connection be granted. <br />Councilman Keckley questioned attitude of Mr. Thomann concerning annexation to <br />the City in view of the request for annexation made several years ago by a <br />number of property owners in the area because of sewer conditions, yet annexa- <br />tion lost. Mr. Brenton stated a property owner had put up $500 as an annexa- <br />tion deposit several years ago, but had lost it after termination date set as <br />annexation not completed. <br />Mr. Brenton was questioned further on the subdivision of this property into the <br />three lots with 25+ improved street fronting on Edgewood Road. Councilman <br />Henderson felt a report submitted on this matter would be helpful as none had <br />been, inasmuch as Staff recommended denial. City Manager recited from Section <br />27.21.1 from the Code which specifically stated sewer connection permits shall <br />not be granted to property outside the City Limits unless extraordinary or <br />exceptional conditions existed, etc., and stated it was the contention of the <br />Staff this application did not meet the criteria stated nor did a hardship exist. <br />Councilman Petersen questioned statement made concerning hardship cases and how <br />determined. City Manager stated it had been past policy of Council where septic <br />tank failures occurred and County Health Department had intervened to order <br />evacuation of premises if conditions not rectified, that a few sewer permits had <br />been granted. Councilman Bury questioned whether it would be possible to annex <br />this property and get normal services from the City. City Attorney indicated <br />annexation was possible as a year or more had elapsed after failure of the <br />annexation in this area. <br />Mr. Brenton stated under the circumstances septic service <br />could be installed on this property, but felt future annexa- <br />tion would be defeated and also advised septic tank on Mr. <br />WH R '6T <br />
