Thomann's property is not in a good condition. Mr. Brenton also stated <br />he was aware of the charges imposed by City for outside <br />services and that he was not opposed to meeting these <br />charges. <br />Councilman Petersen expressed his concern on subdivision of this property as <br />granted by the County, and which would result in a substandard development if <br />annexed to the City. <br />Mr. Brenton stated subdivision as proposed had been approved <br />by the County whether annexation to the City occurred or not, <br />but asked whether it would be possible to enter into an <br />agreement with the City for services requested. <br />Councilman Rosselli moved to deny the application for this sewer connection based <br />on previous efforts which had been made to promote annexation in this area and <br />provide these services. He stated it would be unfair to citizens of the City <br />to do otherwise. Motion seconded by Councilman Petersen. Councilman Henderson <br />stated any time we furnish services outside the City, it should be to a <br />desirable development. <br />Mayor Herkner questioned statement of Mr. Brenton regarding $500 deposit fee <br />alleged to have been forfeited by a property owner and asked this matter be <br />checked to see if any injustice had been done. Motion carried. (MINUTE ORDER <br />(Memo 5/9/67) #67-89) <br />Water Main Construction by City forces - Water transmission lines proposed in the <br />Friendly Acres joint service area. <br />Staff report stated Council had approved the Master Plan for construction of <br />water transmission lines in the Friendly Acres joint service area (Resolution <br />#4956, adopted 3/21/66), and that authorization was also included to expend <br />$17,000 to oversize the Bay Road transmission main, and designating $32,000 to <br />be budgeted for two years for construction of transmission mains in accordance <br />with this Master Plan. <br />Itemized cost of work in Phase I was listed, totaling $26,125.00. Councilman <br />Granger asked that the City Attorney make a statement of facts concerning this <br />joint service area, to become part of the record. City Attorney advised of dis- <br />puted claim of ownership of certain lines by both the City and Clyde Henry; <br />and of the suit filed by Mr. Clyde Henry, owner of Friendly Acres Water Company. <br />If the court determines that Clyde Henry owns these lines, the City will not <br />proceed with the work outlined in the Master Plan. <br />Councilman Rosselli moved to approve the cost estimates presented for proposed <br />construction of water main construction and authorize work be done by City forces, <br />seconded by Councilman Bury. Councilman Granger asked that City Attorney's re- <br />marks be made a part of the record. Councilman Henderson asked for further <br />clarification of the work proposed which was then described by Director of Public <br />Works. Motion carried.
