Mr. Turner repeated his former allegations that removal <br />of dirt by the City in this area had ,jeopardized the situa- <br />tion for all other homes nearby and stated he felt it City's <br />responsibility to either replace dirt or reinforce the face <br />of the slide, and felt City should state its definite posi- <br />tion from this point. <br />Mayor Herkner asked if Mr. Turner would be willing to meet with City Staff for <br />a further discussion of this matter in view of allegations which he had made. <br />City Attorney stated he had previously suggested that Mr. Turner contact Staff <br />and report on the information he alleged to have from experts recently. <br />Mr. Turner stated he would also like to be informed on <br />any insurance that might cover this situation as he knew <br />other property owners in this area were concerned about <br />further spreading of the slide. <br />Councilman Henderson stated report given by City Manager reviewed action <br />authorized by the Council if conditions specified were met. Councilman Rosselli <br />felt it important to remind those present that actions taken by the City in <br />this area in the first instance had resulted only after area declared a disaster <br />area under emergency powers of the City to make it possible for City to protect <br />life and property, and to call in professional and State soil experts and <br />geologists for advice, He felt Council's intended action to further protect <br />and stabilize this area, if conditions met, had been clearly stated, <br />W. Kasser, 989 Nob Hill Rd., asked where plans, which <br />were prepared for redevelopment or protective work of <br />this area, could be reviewed. <br />City Manager explained plans had not yet been submitted to Council for approval, <br />as had been prepared in anticipation of City's having acquired the 2 lots on Nob <br />Hill Road and releases from the property owners involved. Councilman Bury asked <br />whether property owners involved in this area would have a chance to review plans <br />proposed for this corrective work before final determination made, and was advised <br />by the City Attorney Council's approval would have to be made at a public meeting. <br />Mrs. L. C. Warnecke, 930 Nob Hill Road, (owner of Lot 10) <br />asked what other owners adjacent to this slide area could <br />expect in the way of protective measures if conditions not <br />met for City to enter the area. <br />City Attorney stated he felt statements made concerning future spreading of slide <br />area only speculative statements at this point without any factual basis. City <br />Manager reminded those expressing concern for future spreading of slide area <br />that City had taken action to protect other City property and it would be fair to <br />assume City would take necessary action if Nob Hill Road, a City street, should <br />become involved. <br />Mr. Morley Turner again asked for details concerning <br />insurance that might be available by City, or original <br />developers of this area. <br />City Attorney pointed out that insurance carried by home owners was a matter <br />between the carrier and the insured. <br />Mr. Turner made further allegations concerning City's res- <br />ponsibility in this area. <br />Mr, Norman Meadows, Attorney representing Parrago family <br />owning property on Farm Hill Blvd., reported on the many <br />hours given by Council and City Staff to meet for discussion <br />on this problem and aid which was given, stated he resented <br />implications of statements made by Mr. Turner. <br />M <br />W 8 Gl <br />
