115 <br />Councilman Rosselli moved that Variance be granted on modified plan as presented <br />at this hearing, with condition building plan be subject to Architectural Committee <br />approval, and sufficient safeguards be made to insure rear yard would not be used <br />for general storage. City Attorney advised conditions could be added to granting <br />of variance as requested by Council. Motion seconded by Councilman Petersen. <br />Councilman Keckley offered substitute motion to refer this matter back to the <br />Planning Commission for further review and recommendation because of fact modified <br />plan presented at this hearing completely different than the plan presented to <br />Planning Commission on which the publichearing had been held, seconded by Councilman <br />Henderson. <br />Questions of parliamentary procedures were raised and answered by the City Attorney. <br />Mayor Herkner then ruled the substitute motion in order as an amendment to the <br />original motion. Amendment to refer back to Planning Commission lost on roll call <br />vote, Councilmen Granger, Henderson, and Keckley voting yes, Councilmen Bury, <br />Petersen, Rosselli and Mayor Herkner voting no. <br />Original motion to grant variance on modified plan submitted at this hearing, con- <br />ditioned to require architectural approval and prohibition of outdoor storage, <br />carried on roll call vote, Councilmen Bury, Petersen, Rosselli and Mayor Herkner <br />voting yes, Councilmen Granger, Henderson, and Keckley voting no. (MINUTE ORDER <br />Report of Legislative Committee - (Councilman Rosselli, Chairman) #67-124) <br />Councilman Rosselli read full report and recommendation made by Council Committee, <br />comprising himself as Chairman, Councilmen Henderson and Petersen, after a review <br />of pending legislation affecting the City as follows: <br />(I) 1.
