115 Councilman Rosselli moved that Variance be granted on modified plan as presented at this hearing, with condition building plan be subject to Architectural Committee approval, and sufficient safeguards be made to insure rear yard would not be used for general storage. City Attorney advised conditions could be added to granting of variance as requested by Council. Motion seconded by Councilman Petersen. Councilman Keckley offered substitute motion to refer this matter back to the Planning Commission for further review and recommendation because of fact modified plan presented at this hearing completely different than the plan presented to Planning Commission on which the publichearing had been held, seconded by Councilman Henderson. Questions of parliamentary procedures were raised and answered by the City Attorney. Mayor Herkner then ruled the substitute motion in order as an amendment to the original motion. Amendment to refer back to Planning Commission lost on roll call vote, Councilmen Granger, Henderson, and Keckley voting yes, Councilmen Bury, Petersen, Rosselli and Mayor Herkner voting no.
