COMMUNICATIONS: <br />Paul F. Kelly, Attorney representing Rinker Development Co., <br />requesting reconsideration of their application for a re- <br />zoning, which item appeared on Council meeting of 7/10/67, <br />because they did not receive notice of hearing mailed by City <br />Clerk's office. Also attached was an affidavit of H. B. <br />Grabau, representative of Rinker Development Corp, adhering <br />to the fact that no notice of hearing was received by him or <br />his company. <br />Councilman Henderson stated Council had been assured Staff mailed notices of hear- <br />ing as required and felt it not Council's responsibility to guarantee receipt of <br />same by applicants. <br />Upon questioning by Council of consideration that would be possible under the cir- <br />cumstances, City Attorney advised of procedures: (1) no action; (2) reopen public <br />hearing; (3) reinstitute action by referring back to the Planning Commission for <br />review and their consideration of reinstituting proceedings, but that applicants <br />unable to reapply for a period of one year after denial action by the Council. <br />Councilman Granger moved to refer matter to Planning Commission for consideration <br />of reinstituting zoning proceedings by Resolution of Intention of the Planning <br />Commission, seconded by Councilman Keckley and carried. (MINUTE ORDER #67-158) <br />Mayor Herkner asked communication be answered by Staff of action taken by Council. <br />(Memo 7/18/67) <br />Deputy Mayor of Colombo, Ceylon;, expressing appreciation <br />to Mayor Herkner for his communication to their City re- <br />garding the American Field Service representative from their <br />city having acquitted himself with distinction during his <br />stay in our City. City Manager advised Mayor Herkner, on <br />behalf of Council, had written to other Mayors of the various <br />countries for each of the American Field Service representa- <br />tives participating in this program. <br />E. R. Stallings, County Manager, giving information of cities <br />in the County who intend to participate in the County -wide <br />advertising program by agreeing to allocate 25% of revenue <br />received from their hotel -motel tax revenue for this purpose. <br />Councilman Granger requested a referral to Planning Commission of "ingress and <br />egress easements" for review. City Attorney advised subject referred to is covered <br />by Ordinance but Council does have the power to grant exceptions. <br />Councilman Granger also questioned whether a study is being made for traffic <br />patterns now, to insure resolving of problems which will occur when colleges are <br />completed as proposed. <br />Mayor Herkner reported on meetings now being held at County level for resolving <br />future traffic problems anticipated. City Manager also reported on signalization <br />plans for Jefferson and El Camino as it was expected main traffic from Canada Cam- <br />pus would be down Jefferson Avenue. <br />Councilman Petersen moved to adjourn the meeting, seconded by Councilman Henderson and <br />carried.
