COMMUNICATIONS: Paul F. Kelly, Attorney representing Rinker Development Co., requesting reconsideration of their application for a re- zoning, which item appeared on Council meeting of 7/10/67, because they did not receive notice of hearing mailed by City Clerk's office. Also attached was an affidavit of H. B. Grabau, representative of Rinker Development Corp, adhering to the fact that no notice of hearing was received by him or his company. Councilman Henderson stated Council had been assured Staff mailed notices of hear- ing as required and felt it not Council's responsibility to guarantee receipt of same by applicants. Upon questioning by Council of consideration that would be possible under the cir- cumstances, City Attorney advised of procedures: (1) no action; (2) reopen public hearing; (3) reinstitute action by referring back to the Planning Commission for review and their consideration of reinstituting proceedings, but that applicants unable to reapply for a period of one year after denial action by the Council. Councilman Granger moved to refer matter to Planning Commission for consideration of reinstituting zoning proceedings by Resolution of Intention of the Planning Commission, seconded by Councilman Keckley and carried. (MINUTE ORDER #67-158) Mayor Herkner asked communication be answered by Staff of action taken by Council. (Memo 7/18/67) Deputy Mayor of Colombo, Ceylon;, expressing appreciation to Mayor Herkner for his communication to their City re- garding the American Field Service representative from their city having acquitted himself with distinction during his stay in our City. City Manager advised Mayor Herkner, on behalf of Council, had written to other Mayors of the various countries for each of the American Field Service representa- tives participating in this program. E. R. Stallings, County Manager, giving information of cities in the County who intend to participate in the County -wide advertising program by agreeing to allocate 25% of revenue received from their hotel -motel tax revenue for this purpose. Councilman Granger requested a referral to Planning Commission of "ingress and egress easements" for review. City Attorney advised subject referred to is covered by Ordinance but Council does have the power to grant exceptions. Councilman Granger also questioned whether a study is being made for traffic patterns now, to insure resolving of problems which will occur when colleges are completed as proposed. Mayor Herkner reported on meetings now being held at County level for resolving future traffic problems anticipated. City Manager also reported on signalization plans for Jefferson and El Camino as it was expected main traffic from Canada Cam- pus would be down Jefferson Avenue.
