411 <br />Staff report stated two segments of this property had been rezoned by Council to <br />IP -T -A and IP -A after public hearings; segment on appeal for IR -A zoning for <br />service station, as part of development complex of motel -restaurant, was referred <br />back to Planning Commission for further consideration after a public hearing held <br />on December 5th. Request forrehearing made by appellants at Councilmeeting of <br />December 12th after Planning Commission reaffirmed their original denial of this <br />appeal for IR -A zoning. Appellants indicated new pertinent information would be <br />available if request for new public hearing granted. <br />H. B. Grabau, representative of Harker Development Co., <br />1535 Vineyard Dr., Los Altos, briefly reviewed points <br />on which appeal had been based for this one segment of property <br />to IR -A zoning for site of service station, because it <br />was economically impossible to carry out a one-half to 3/4 <br />million dollar development without this being granted as it <br />represented about 1/5 of total development and carried a much <br />higher burden of cost of land than the 1/5 because of it <br />being a prime site on commercial frontage. <br />He advised a deal had been finalized with a restaurant and <br />they were ready to build both restaurant and service sta- <br />tion concurrently, provided no unforeseen change made it <br />impossible. <br />Councilman Granger questioned whether company would post a bond to this effect <br />City Attorney advised this was not an appropriate situation for posting of bond <br />as public hearing pertained to a zoning matter, a bond being meaningless unless <br />some supporting obligation existed. <br />Mr. Grabau advised Mobile Oil Company had previously <br />stated they would not build a service station on this <br />property unless restaurant or some other type of business <br />there. <br />Councilman Petersen restated his conviction that service station should not be <br />permitted until at least 40% of restaurant completed and felt this should be <br />acceptable. Councilman Henderson questioned access to proposed developments on <br />this site and if plans had been approved. City Manager advised problem of access <br />had been reviewed and approved by Traffic Engineer. Planning Director also <br />advised Staff had not been opposed to entrance to motel by mutual easements. <br />Councilman Henderson also questioned better design for proposed service station in <br />view of having noted an award being made to a service station in Carmel recently. <br />City Attorney advised this was prime function of Architectural Committee to en- <br />courage better designs on all proposed construction under their jurisdiction. <br />Councilman Keckley moved to close the public hearing as he felt no new evidence <br />had been inserted in this hearing. Councilman Granger asked that Chairman of <br />Planning Commission, present at the meeting, advise why this matter denied at <br />their hearing. <br />Mr. Allen, Chairman of Planning Commission, stated <br />Commission felt there were enough gas stations sur- <br />rounded by vacant property and felt no guarantee possi- <br />ble if rezoning granted this would not also be the case. <br />Mr. Grabau stated they did stand ready to guarantee develop- <br />ment of service station and restaurant concurrently as stated. <br />
