Discussion helf of protest against charges made by representative of this Company for weed abatement around fences of property for which they had paid a. private contractor yearly to control. Staff questioned concerning description of area claimed to have been weed abated by City. Councilman Bury moved to deny protest and refer same back to Staff for negotiation if such an adjustment is in order, seconded by Coun- cilman Petersen. Assistant City Attorney advised motion must be either confirmation, cancellation, or modification of assessment charges. Any negotiation by Staff would not be a part of this action. Motion to deny protest and confirm assessment charges carried unanimously on roll call vote. (Staff to review) ASSESSMENT CONFIRMED Mayor Herkner called a recess of ten minutes at 10:00 P. M. Continuation of A. D. McKelvy assessment charges: Staff reported on check made of the map of the property and of the allowance which had been made for one inundated area, making a reduction of assessment charges in the amount of $42.00. After prolonged discussion of all evidence submitted, Councilman Bury moved to deny the protest and confirm the assessment charges, seconded by Councilman Petersen and carried on roll call vote, Councilmen Bury, Granger, and Petersen voting yes, Mayor Herkner voting no. (Staff to review) ASSESSMENT CONFIRMED Councilman Petersen, because of evidence heard tonight and August 7th public hearing indicating an unsatisfactory weed abatement program, moved City contribute 100% to this year's program and immediately begin to work for a better program next year, seconded by Councilman Rosselli. Council questioned effect of contri- bution of some $36,000 on the City's Budget. City Manager advised of Budgeted Reserve of $50,000, Emergency Fund of $150,000, and the $250,000 Charter Reserve which could not be used for this purpose. Council also questioned possible addi- tional revenues which might be anticipated since adoption of Budget, and might be used for such a purpose. City Clerk advised at such time as City has collected the anticipated revenues, anything over and above that would go into Un -Budgeted Reserves, and could be appropriated for any purpose Council saw fit. Councilman Bury expressed his reasons for feeling contribution proposed not equit- able and a fallacy to feel it would resolve situation, being more of a subsidy. Councilman Keckley also expressing views of inequities of a City contribution pro- posal as all taxpayers not involved in this program, and some having abated their weeds themselves. Councilman Rosselli expressed reasons for favoring City contri- bution as felt image created by these unfortunate circumstances a detriment for inducement of industry to the City. Motion lost on roll call vote, Councilmen Petersen and Rosselli voting yes, Councilmen Bury, Granger, Keckley and Mayor Herk- ner voting no.
