41 u � Councilman Bury moved to adopt RESOLUTION NO. 5484 APPROVING AND AUTHORIZING EXECUTION OF AGREEMENT FOR THE CONSTRUCTION OF CERTAIN SEWER IMPROVEMENTS IN THE VICINITY OF BROADWAY AND THE WOODSIDE EXPRESSWAY - DMA CORPORATION, seconded by Councilman Keckley. Staff report stated this installation is required by three Use Permits covering a restaurant, a filling station, and a motel on the property bounded by the Wood- side Expressway, Bay Road, Broadway and the Federal Mogul property. Agreement will guarantee the installation of the sanitary sewer to serve these three properties, and will enable the owners to initiate construction of the restaurant. Motion carried on roll call vote. Councilman Henderson moved to adopt RESOLUTION NO. 5485 APPROVING AND ADOPTING PLANS FOR IMPROVEMENT OF PROPERTY IN THE VICINITY OF BROADWAY, WOODSIDE EXPRESSWAY, BAY ROAD AND CHESTNUT STREET SUBDIVIDED BY FEDERAL MOGUL CORPORATION, AND APPROVING AND AUTHORIZING EXECUTION OF AGREEMENT FOR THE CONSTRUCTION OF IMPROVEMENTS, seconded by Councilman Bury. Staff report stated this agreement provides for installation of the sidewalks, street monuments, sanitary sewers, and the filing of a parcel map which were requirements of the resubdivision necessitated by the proposed sale of Federal Mogul lands to DMA Corporation for proposed development. Motion carried on roll call vote. Status Report, Farm Hill Slide Area. City Manager stated very little more to report on status of this problem area since Council is aware of the conditions which had been set, requiring releases to City from property owners involved in order City might proceed to enter this area for repair and rebuilding work. He advised plans and speci- fications had been prepared for this stabilization work, but that attorney for property owners on Farm Hill Boulevard area had requested before any releases were given to City, assurance that plans proposed would correct condition. He advised of the report made by Dames & Moore, soils engineers, indicating their recommendation for corrective action which amounted to a substantial undertaking, and of his also having discussed this situation with another soils consultant for his proposal con- cerning method of stabilizing the area. He stated a field trip had been taken this morning with a representative of this consulting firm, Sherman & Wilson, well-known soil engineers in Seattle -Portland area with local offices in Burlingame, but that there had not been sufficient time to review the preliminary report made, and asked that he be given further time to make a report and analysis to Council. He stated he felt City had armoral commit- ment to proceed with undertaking stabilization of this slide area and may be sub- ject to criticism if no further action is taken and on -coming rains caused a mud flow damaging public areas on both Farm Hill Boulevard, and Nob Hill Road. He further stated he still had not received a report from Attorney as to meeting which had been held with property owners. Councilman Rosselli asked whether it would be possible for City to post "keep out" signs on upper level of slide as warn- ing of dangers. Discussion was held as to whether posting by City on private property would result in incurring liability.
