232 Councilman Petersen moved to adopt RESOLUTION NO. 5493 WITHDRAWING ANNEXED TERRITORY KNOWN AS "LAKEVIEW WAY NO. 1 ANNEXATION" FROM EMERALD LAKE LIGHTING DISTRICT AND WOODSIDE FIRE PROTECTION DISTRICT, seconded by Councilman Henderson. Staff reported annexation is now completed. Motion carried on roll call vote. Councilman Rosselli moved to adopt ORDINANCE NO. 1329 REPEALING ORDINANCES NOS. 1305 AND 1307 AND AWARDING NON-EXCLUSIVE FRANCHISE TO CONSTRUCT, OPERATE AND MAINTAIN A — COMMUNITY ANTENNA TELEVISION SYSTEM WITHIN THE CITY OF REDWOOD CITY TO PENINSULA CABLE TELEVISION CORPORATION; AND ESTABLISHING CERTAIN CONDITIONS THEREFOR, seconded by Councilman Keckley and carried on roll call vote. Acceptance of reroofing of 3.75 million gallon reservoir by Robert F. Smith Company as recommended by Staff, subject to a 2-yeqr guarantee approved on motion of Council- man Henderson, seconded by Councilman Petersen. Staff clarified conditions of 2 -year guarantee, which covers defective materials and poor workmanship. Motion carried. (MINUTE ORDER #67-192) DAMAGE CLAIM of Mrs. John F. Alonso, on behalf of Marty Alonso, a minor for personal injuries alleged to have been caused by a City Employee during Redwood Day Camp at Stulsaft Park, denied and referred to insurance carrier on motion of Councilman Petersen, seconded by Councilman Keckley and carried. (MINUTE ORDER #67-193) COMMUNICATIONS: San Mateo County Board of Supervisors, signed by Supervisor Fitzgerald, urging Council's support of Governor's program for honoring City and county governments by proclaiming the week of October 8-14, 1967 'Salute to City and County Govern- ment Week" and join County in activities proposed. (copy submitted to Council) Mayor Herkner stated that Council had already taken action supporting this proposed program and he was to make an appointment of a Citizens Chairman as requested. Communication from County of San Mateo, signed by County Manager, E. R. Stallings, referring to Senate Bill 837, Chapter 1332, Local Property Transfer Tax, authorizing counties and cities to impose a tax on instruments of con- veyence with respect to real property transfers, and asked that County Recorder be advised if City is contemplating the adoption of an enabling ordinance so that our City might be included in the computer program planning necessary. In answer to Council questioning of implications of this legislation, City Manager advised he had been informed by County Recorder, Mr. Church, County does intend to pass an ordinance to be effective January, 1968, and it was his understanding all funds collected would go to the County unless cities in the County also adopted an enabling ordinance permitting participation of the revenue so collected. He stated that the Federal Government is collecting this tax at present but that the Federal tax would cease December 31, 1967, and it was understood the Federal Government would not seek its reenactment. He stated it was difficult to estimate what revenue would be derived from this source if City did pass such an ordinance to participate in the revenue, but that revenue for whole of County is estimated to be $377,000 per year. He asked that Council either refer this matter to a Council Committee for investi- gation or that Staff be directed to make the investigation and report to Council with a recommendation. After further discussion, Councilman Rosselli moved to refer this matter to Staff for study and report to the Council in three weeks (Oct. 9th), seconded by Councilman Keckley and carried.
