W <br />Councilman Keckley moved that Planning Staff be directed to study zoning <br />districts at issue in this matter in view of discussion held and submit <br />recommendation for prescription pharmacies in these areas, seconded by Coun- <br />cilman <br />Bury. <br />Councilman Rosselli stated <br />this study had been under way for two <br />years. <br />Motion <br />carried on roll call vote, <br />Councilmen Bury, Henderson, Keckley, _ <br />Petersen and Mayor Herkner voting yes, Councilmen Granger and Rosselli voting <br />no. (MINUTE ORDER #67-36) <br />Mayor Herkner ordered 10 minute recess at 10:00 P. M. <br />CATV License Applications. City Manager's report and recommendation read in <br />which Council was advised of the two additional firms which had indicated <br />their interest in submitting applications for a franchise, subsequent to the <br />two applications which had been reviewed by the Council on February 13th. He <br />advised a formal written application and accompanying brochure had been sub- <br />mitted by the M & M Cable Company, 1606 Grant Avenue, Novato, Calif., which <br />Staff had not yet analyzed completely, and that the Community Antenna TV <br />Company, 734 Overland Way, San Jose, had also indicated an interest in sub- <br />mitting an application, but for which a written proposal had not yet been <br />received. <br />City Manager recommended establishment of a cut-off date for receipt of addi- <br />tional applications for twelve noon, Wednesday, March 1, and submission of <br />analysis to Council for their consideration on March 6th, together with <br />suitable agreement containing the conditions of the franchise, including pro- <br />visions for rate analyses, performance bond, specific system completion date, <br />etc. Councilman Rosselli moved this be placed on Council Agenda of March <br />6th and cut-off date for receiving applications be set for March 1st as <br />recommended by Staff, seconded by Councilman Petersen. <br />Mr. Linebarger, of Community Antenna TV Company <br />again stated he did not think it possible for his <br />Company's proposal to be completed by March lst, <br />Indicating an additional week would be sufficient. <br />He felt City could afford to give plenty of time <br />for consideration on granting of such a franchise. <br />Councilman Rosselli felt sufficient time had been granted to applicants and <br />unfortunate Mr. Linebarger's company not aware of City's ordinance. City <br />City Manager stated the two applications which had been considered by Council <br />had been received first part of November, 1966, and felt City's CATV ordinance <br />had been given adequate publicity. <br />Councilman Bury expressed concern on procedure and also questioned whether <br />original applicants needed more time to amend their proposals, if they wished <br />to do so. Councilman Granger asked the maker to amend the motion to continue <br />this matter for one week in order additional bid could be submitted and thereby <br />insure City of getting best possible deal with analysis of additional bids. <br />Maker and second of original motion declined to amend their motion. <br />Councilman Henderson questioned possibility of starting all over again on pro- <br />cedures for submittal of proposals for serving City with a CATV system and <br />
