Burget, Deputy Police Chief Theodore Moudakas, <br />Fire Chief J. L. Lodi, Planning Director Ken Schroeter, Deputy Director of <br />Public Works Glenn M. Jain, Auditor -Accountant Jack Ference, Recreation Director <br />A. S. Morton, Park Superintendent Pasco Balzarini, and Deputy City Clerk Marian <br />McCrindle. <br />Councilman Bury moved to approve Minutes of Regular Meeting of March 11, 1968, <br />as mailed. City Clerk reported two corrections in the text; one in the tennis <br />court item and one in the discussion held on Accounts Payable in Minutes of <br />March 11, 1968, had been requested by Councilman Henderson. Councilman Bury <br />moved to approve Minutes of Regular Meeting of March 11, 1968, as corrected, <br />seconded by Councilman Henderson and carried. <br />Continued PUBLIC HEARING, Application of LEO DEVELOPMENT COMPANY for a Planned <br />Development Permit, under Article 46, Zoning Ordinance, as a portion of WINDSOR <br />GARDENS, to allow the development of 18 townhouse units and a 36 -unit apartment <br />building, located northwesterly side of Carlos Avenue on both sides of Leahy <br />Street to Fox Court, 2.71 acre area (APN 59-162-22 and 59-166-02) in "R -2-P" <br />and "R -3-P" Zoning Districts, declared open. <br />It was noted this public hearing had been continued at Councils request <br />from meeting of March 4th in order that Council might have additional <br />time to review this matter and receive the additional material requested. <br />Report of Planning Commission read in which action of the Commission, after a <br />public hearing, resulted in their unanimously recommending that the Planned <br />Development Permit be approved subject to the following conditions: <br />(1) That the subject Planned Development Permit shall in- <br />clude Block B. and that the conditions and exceptions <br />pertaining to Blocks A and B, as approved in the afore- <br />said PD67-02 and PD 65-01, be applicable to PD68-02. <br />(2) That the subject permit shall apply to Block A and Block <br />B regardless of future changes of ownership. <br />(3) That the zoning district side yard requirements be met <br />adjacent to the neighboring property for Lots 2 and 19, <br />Block A. <br />(4) That the final subdivision map be recorded prior to record- <br />ing Planned Development Permit PD 68-02. <br />(5) That Lot 1, Block A, be maintained as permanent common <br />open space as stipulated in the deed restrictions as pre- <br />viously approved by the Planning Commission at their <br />meeting of June 22, 1965. <br />Staff report and other review material concerning previous actions taken on <br />this Planned Development Permit, which had been submitted to Council for re- <br />view, was noted. Letter of protest against decision of Planning Commission, <br />dated February 26, 1968, submitted by Leo Development Company, read in full <br />In which specific points were protested regarding their not being allowed 1' <br />setback on Lots/and 19, when overall setback would be greater than 5' average; <br />detailing reasons for their believing plan as proposed by them would make for <br />a more desirable Planned Development overall, and their intended allowable <br />Option to re -arrange their planning if not granted the 1' setback requested, <br />but which was not thought to be the best overall plan for development of their <br />property. <br />44( <br />0 is" <br />
