lot split, making one parcel of property and then proceed with the parking <br />arrangements, seconded by Councilman Henderson. <br />After discussion and questioning of the City Attorney as to whether negating of <br />the property's subdivision could be requested, and City Attorney's remarks that <br />in his opinion this request was not necessary either, Councilman Petersen indica- <br />ted he still felt negating property's present subdivision should be done as it had <br />been indicated there was a willingness on part of appellants to comply with this <br />suggestion. <br />Councilman Bury indicated his favoring two motions, one denying use permit because <br />of lack of authority to grant as stated by City Attorney, and a referral back to <br />Planning Commission for further review of pedestrian entrances to restaurant area <br />as felt other similar circumstance in case of the King's Restaurant had preseted <br />problems which might have been avoided if a solution had been made in the first <br />instance. Motion carried, Councilman Bury voting no. (MINUTE ORDER #68-1) <br />Mr. Tillett asked that ruling of the Council be explained by <br />the City Attorney so rearrangement of parking proposed may be <br />made without further dispute. <br />City Attorney advised he would be happy to make such a report to clarify action of <br />the Council, if no objection of the Council. Further discussion and questioning of <br />Staff held concerning fact that this matter had proceded through the Planning Com- <br />mission and presented to Council if no authority had existed for such procedures. <br />Councilman Granger moved to direct the City Attorney to prepare a legal opinion on <br />this matter as requested by Attorney for the appellants, seconded by Councilman <br />Petersen and carried. (MINUTE ORDER #68-2) <br />Mr. Robert Dell'Ergo, Attorney, representing persons interested in Agenda item for dis- <br />cussion of the recommendation of the Planning Commission concerning a proposed amend- <br />ment to the "PO" and "0" Districts, requested Council consider continuing this item <br />as he had been only recently contacted to appear on their behalf and had not had <br />sufficient time for study. <br />Councilman Granger moved to continue this item for one week, seconded by Councilman <br />Petersel Councilman Keckley indicated his disapproval of granting continuance of <br />this matter because he felt sufficient time had been given for review of this matter <br />from previous continuances. Councilman Henderson asked Mr. Dell'Ergo to present <br />a listing of clients he is claiming to represent to Council. <br />Councilman Keckley questioned action proposed by Council when this matter is pre- <br />sented and whether public hearings were proposed. It was pointed out that public <br />hearings will be required before both the Planning Commission and Cty Council, as <br />for any amendment to the Zoning Ordinance. Motion carried. (MINUTE ORDER #68-3) <br />Downtown Traffic Study Program (Peat, Marwick do Livingston) ' <br />City Manager referred to report he had submitted to Council concerning request which <br />had been made by representatives of certain downtown merchants for modification of <br />the traffic study program to allow channelization on Broadway for left turn storage <br />and diagonal rather than parrallel parking, and of the series of meetings held to <br />A s •se <br />
