further described the improvement work proposed to be done under the guidance <br />of and as recommended by the consulting soils engineers, Shannon & Wilson. <br />He advised Nob Hill Road would be restored in its present condition after <br />drainage borings were covered, and of the grading to be done on two lots to <br />be owned by City at top of slide by City expense, further grading below to be <br />_ done at property owners' expense. <br />Mr. Morley Turner, representing owner of Lot 13, advised <br />he had not been notified of action proposed and it was <br />apparent from illustrated chart of proposed corrective <br />work that easements would be required of Lot 13. <br />Acting City Attorney advised easement as indicated on the illustrated chart <br />could not be negotiated for until after Council approval of the proposed plans <br />and specifications, therefore, contact of those involved is not possible before <br />this action taken. He further advised it should be patently clear that there <br />could not help but be benefits to surrounding area of slide with improvements <br />proposed. He also asked if Mr. Turner had authority to represent the owner of <br />Lot he was referring to. <br />Mr. Turner also alleged he had been advised by the City <br />in a communication some two or thee months ago of the <br />dangers apparent with his swimming pool and warned it <br />should be drained. <br />After further discussion concerning comunication alleged to have been received <br />by Mr. Turner from City, Acting City Attorney requested that Mr. Turner dis- <br />cuss this further with him at his offices. In respect to easement across Lot <br />13 not being granted by property owner, City Manager advised that soils engin- <br />eers had advised this line could be eliminated as well as part of the drainage <br />gallery proposed in front of Lot 13. Acting City Attorney advised Council <br />that points expressed by Mr. Turner were basically of a self-serving nature, <br />and urged Council proceed with specific action proposed. <br />Norman Meadows, Attorney representing Mr. Parraga, owner <br />of Lot 4 fronting on Farm Hill Blvd., asked if plans now <br />proposed differed in any way from those which had been <br />discussed at meeting held in January with property owners <br />involved. <br />Director of Public Works advised present proposed plans were identical to those <br />discussed in January with the parties involved. <br />Mr. Meadows also asked whether any drainage easements <br />involved would affect any of lots facing on Farm Hill <br />Blvd. <br />Director of Public Works advised that no drainage easements were needed for lots <br />at lower level. Motion to adopt Resolution carried unanimously on roll call vote. <br />In reply to questioning as to the availability of slide area improvement reports, <br />City Manager advised he would ask for more copies to be made available. Mayor <br />Herkner advised Mr. Turner he would notify him as to the availability of a copy <br />for his use, but that a copy was available for his inspection in the City Clerk's <br />office.
