41 8 <br />i <br />Mr. Leps, of Leo Development Company, advised a two <br />weeks continuance would be satisfactory, but had hoped <br />for a decision at this meeting as delays were costly; <br />would submit additional maps, but had been under im- <br />pression Planning Commission had submitted adequate <br />information and maps as this subdivision had been before <br />them many times. <br />Mayor Herkner requested that Staff furnish information on this matter as <br />requested before the public hearing on March 18th. Motioncarried.(MINUTE ORDER <br />#68-59) <br />The Exceptions requested by Leo Development were also continued, since they <br />are closely integrated with the Planned Development Permit. <br />PUBLIC HEARING, Notice to Abate Nuisance at 102 Hemlock Avenue, Redwood City,(2 <br />dilapidated buildings) declared open and affidavits of posting and mailing <br />ordered filed. Chief Building Official was duly sworn in by City Clerk <br />before presenting his testimony on this proceeding by reading his first report, <br />dated February 15th, in full detail containing the substantiating evidence to <br />support his testimony, and full record submitted containing the following: <br />complete documentation of records which had been compiled as the basis for his <br />recommendation that these hazardous buildings be demolished, consisting of <br />discussions held with owners of property, Mt. Zion Baptists, Inc., investigation <br />made of these dwellings, photographs, etc., and recommendation made for their <br />demolition in absence of voluntary abatement by owners. He also read in full <br />his revised report, dated March 1st, advising that one of the structures, and <br />attached dilapidated accessory structure, had been removed from the site, but <br />that same deficiencies remained in the remaining structure covered by his re- <br />commendation that property be cleared of the two dilapidated structures. (For <br />full reports see City Clerk's File - Abatement) <br />Acting City Attorney asked specific questions of Chief Building Official in <br />order to perfect the records as to whether statements of act indicated in his <br />report and so submitted were true to the best of his knowledge; on basis of <br />statements of act made, whether he had reached a conclusion as to structures <br />safety for human habitation of the buildings, and concluding with his judgment <br />being to request abatement of the buildings as they constitute a public nuisance. <br />Chief Building Official answered all questions in the affirmative. <br />Mr. Lonnie McLain, Chairman of Board of Trustees of Mt. <br />Zion Baptist Church, owners of the property, advised <br />the remaining building on the property would have also <br />been demolished before this hearing but that tenants <br />occupying premises had not moved. They had been noti- <br />fied -on numerous occasions to vacate the premises but <br />had not complied because they had been unable to re- <br />locate themselves. <br />He advised further that their Church had bought the <br />property and were anxious to remove the structures <br />in order they might proceed with their building plans. <br />He asked that an additional 30 days be granted before <br />demolition ordered by Council in order tenants might <br />find other quarters. <br />Councilman Petersen expressed opinion that because Council and City had <br />
