7.A. - Page 43 Id lack of maintenance, causing negative impact upon the health, safety, <br />welfare and economic prosperity of the City and its citizens. Because of the unique <br />nature of the problems created by condominium and community apartment projects, it is <br />the express intent of the City to treat such projects differently from other types of multi- <br />family dwellings and to establish rules and standards thereof, regulating the <br />construction of, and conversion to, condominium projects and community apartment <br />projects in the City." <br />In accordance with this purpose, the Final Map will be reviewed for substantial <br />conformance with the Tentative Map pursuant to all applicable standards outlined in <br />Chapter 30 of the Municipal Code. Conformance with these standards will occur prior to <br />City Council approval of the Final Map. <br />Planned Development Permit <br />Pursuant to Article XI, Section 30.134 of the Subdivision Ordinance, approval of a <br />Planned Development (PD) Permit is required as part of the approval for a <br />Condominium Permit. Section 46.7 of the Zoning Ordinance states that the Planning <br />Commission may approve a PD permit if the project will provide an environment of <br />physical and functional desirability, in harmony with the character of the surrounding <br />neighborhood and the DTPP area. As discussed in previous sections of this Staff <br />Report, the project complies with all of the standards established in the DTPP, and the <br />AAC has recommended approval of the five proposed deviations from the guidelines. In <br />addition, the HRAC has determined that the project will not cause a substantial adverse <br />change in the significance of the historic resource at 620 Jefferson Avenue, and that it <br />will remain eligible for listing in the California Register. <br />ENVIRONMENTAL REVIEW <br />In 2010, an Environmental Impact Report (State Clearinghouse #2006052027) was <br />prepared to assess potential impacts resulting from the implementation of the DTPP. <br />The DTPP established new land use, development, and urban design regulations for <br />the 183 -acre DTPP area, including the potential for up to 2,500 net new dwelling units, <br />and 100,000 net new square feet of retail development. The DTPP Environmental <br />Impact Report (EIR) was certified by the City Council on January 24, 2011. <br />An Initial Study checklist has been prepared to consider whether any new effects not <br />identified in the DTPP EIR may be created by construction of the proposed 603 <br />Jefferson Avenue project. To date there has been less than 1,000 net new square feet <br />of retail development approved under the DTPP, and the proposed project would add <br />approximately 200 new square feet of retail to this total due to the demolition of the <br />existing building on the site. The proposed project would bring the total number of net <br />new dwelling units approved under the DTPP to 1,699. The Initial Study checklist <br />confirmed that the proposed project would not result in any new environmental impacts <br />or substantial increase in the severity of any environmental impact beyond those <br />previously identified in the DTPP program EIR. Nor would the project require new <br />mitigation measures beyond those identified in the DTPP program EIR and adopted <br />upon approval of the Downtown Precise Plan. In addition, the Project is consistent with <br />the Downtown Precise Plan, as discussed herein, and there are no Project -specific <br />environmental effects which are peculiar to the Project or the site. Thus, no further <br />environmental review is required, pursuant to sections 15162, 15163, 15164, 15168, <br />and 15183 of the CEQA Guidelines. <br />
