• The District will construct a new public restroom building adjacent to the <br />athletic field at its expense for park use. The City will own and maintain the <br />restroom building. <br />• City and District representatives will form a Working Group to establish a <br />schedule for use of facilities, review maintenance and replacement needs of the <br />facilities and grounds. <br />• District will indemnify the City from any third-party claims arising from the <br />project. <br /> <br />As described above (Review Authority, page 3), the City’s Real Property Acquisition <br />and Disposal policy requires the Planning Commission make a determination of <br />General Plan consistency prior to disposition of City property. The Planning <br />Commission adopted Resolution 16-24 at its December 6, 2016 meeting finding that <br />the proposed disposition of City property is consistent with the General Plan, as the <br />General Plan would be amended by the proposed General Plan Amendment before <br />Council. <br /> <br />ALTERNATIVES <br />1. Deny the Initial Study and Mitigated Negative Declaration (IS/MND) and/or <br />General Plan Land Use Map Amendment. <br />2. Continue the staff recommendation to a later date and direct staff to provide <br />additional planning and environmental analysis <br /> <br />FISCAL IMPACT <br />Staff and Planning Commission’s recommendation to approve the IS/MND and General <br />Plan Land Use Amendment would not result in any new fiscal impacts. Approving the <br />Ground Lease and amendment to the Joint Use Facility Agreement are not expected to <br />generate significant additional revenues or expenses, in that the lease agreement <br />includes only a nominal yearly rental fee payable by the District to the City and the Joint <br />Use Agreement is structured so that costs for maintenance at the Joint Use Site are <br />shared and, moreover, such costs are not expected to be significant. <br /> <br />ENVIRONMENTAL REVIEW <br />In accordance with the California Environmental Quality Act (CEQA), an Initial Study <br />and Mitigated Negative Declaration (IS/MND) were prepared. These documents <br />evaluated environmental impacts anticipated by the Project, and with the <br />implementation of applicable mitigation measures, concluded that there would be no <br />significant impacts to the environment. The 30-day CEQA required review and <br />comment period for the IS/MND commenced on November 4, 2016 and ended on <br />December 6, 2016.
