Councilman Murray stated that the City collected too much money in penalties <br />during the last rationing period and that a greater attempt should be made <br />to stop excessive use rather than charge excessive penalties. <br />General Services Director Sennewald advised the $800,000 collected in <br />penalties was used to offset a water rate increase for all water users; and <br />staff was about to install a few water restrictors when rationing came to an <br />end. Director Sennewald added that the majority of water users in Redwood <br />City have continued water conservation methods and the expectation is that <br />fewer penalties will be assessed this rationing period. <br />M /S: Stangel /Bury to approve the 1st reading of the water shortage <br />emergency ordinance and set a Public Hearing on June 11, 1990, at the <br />Board of Supervisors Chambers, 401 Marshall Street, Redwood City. <br />Councilman Murray_ described the proposed administration charge of $50 per <br />day as excessive as it could amount to $1500 per month, staff would not <br />be unable to go out and check the violations everyday, and we would be <br />better served if the water was restricted instead of assessing fines. <br />In response to Council questions City Attorney Schricker advised the <br />administrative enforcement charge only applies to violations of Section 5, <br />Subdivision (b) such as water running down driveways etc. and does not apply <br />to excess usage of metered water. The old ordinance did not provide a <br />penalty for violations except to file a misdemeanor. This is a compensatory <br />charge each time staff responds to a violation, which charge barely covers <br />the cost of staff response time. <br />Councilman Murray requested an amendment to the motion to reflect the <br />following change to the proposed ordinance: Insert the amount $5.00 between <br />the words "or" and "for" on Page 9, sentence 11, to read: "($50.00) for <br />each such violation, or $5.00 for each day..." <br />The originator of the motion, Councilman Stangel, accepted the amendment, <br />but Councilman Bury who seconded the original motion, did not accept the <br />motion to amend and withdrew his second of the original motion. <br />M /S: Murray /Claire to amend original motion by adding the following: <br />Insert the amount $5.00 between the words "or" and "for" on page 9, <br />sentence 11 of the proposed ordinance. <br />The motion failed on the following vote: <br />AYES: Councilmembers Claire, Murray and Stangel <br />NOES: Councilmembers Buchan, Bury and Mayor La Berge <br />Title read.
