<br /> <br /> <br />ANALYSIS <br />There are three properties to be transferred as follows: <br /> <br />PROPERTY APN LOCATION CURRENT USE <br />Library Parking Lot 053-137-010 1012 Main Street Public parking, 53 <br />spaces <br />Culvert Parcel 053-147-040 Intersection of Lathrop, Culvert <br /> Maple and Elm operations and <br />maintenance; <br />open space <br />Courthouse Square <br />Kiosk Easement <br />052-367-010 2200 Broadway Public plaza kiosk <br />concessions <br /> <br />Although all of the properties listed in the table above fall within the category of <br />governmental use, the Successor Agency’s interests in the properties vary. Two of the <br />properties are owned in fee, and the other property is an easement interest (Courthouse <br />Square Kiosks). The method for conveyance of the properties from the Successor Agency to <br />the City for continued long term public ownership and use therefore differs for each <br />property interest. For the fee parcels (Culvert Parcel and Library Parking Lot), the <br />conveyance will occur by grant deed. <br /> <br />For the Courthouse Square kiosk easement, the prior assignment from the City to the <br />Redevelopment Agency will be rescinded. The execution of the Rescission Agreement <br />will result in the City assuming the rights and obligations pertaining to the Courthouse <br />Square kiosks and will permit the City to lease out the kiosks which in turn enables staff to <br />begin a process for determining their availability for lease and best use. <br /> <br />NEXT STEPS <br />1. Appraise the Lathrop and Main Culvert Parcel and dispose of the property through <br />sale. While this may make the property available to other interested parties, the City <br />would be able to make an offer for purchase of the property. This would allow the <br />City to obtain the property for governmental use by fee should the City determine <br />this to be a reasonable use of funds. <br /> <br />2. Obtain approval from the USPS to terminate the Outlease Agreement between the <br />Successor Agency and the USPS. Alternatively, obtain confirmation that the USPS <br />asserts that the Outlease Agreement between the USPS and the Successor Agency <br />is expired. <br /> <br />3. Develop and enter into a new Outlease Agreement between the USPS and the City <br />for the Jefferson Avenue Paseo to ensure its availability for public pedestrian <br />6.1.E. - Page 3
