access. Since the Jefferson Avenue Paseo is not owned in fee, the City may work <br />directly with the USPS to lease the Jefferson Avenue Paseo for continued public <br />access. <br /> <br />4. Subsequent to Successor Agency Approval and City Council Acceptance of the <br />Courthouse Square Easement, staff will develop possible proposals for existing and <br />future leases of Courthouse Square Kiosks. <br /> <br />ALTERNATIVES <br />The Successor Agency could not approve the transfer of these properties. Should the <br />properties not be transferred to the City, the City may lose Downtown Library parking <br />spaces, the ability to operate and manage the Courthouse Square Kiosks, and a <br />maintenance access point along the Redwood Creek Culvert. <br /> <br />FISCAL IMPACT <br />There are no direct costs tied to the transfer of the three properties from the Successor <br />Agency to the City. Though the Redevelopment Agency and later, the Successor <br />Agency, oversaw use or potential use of the aforementioned properties, the City <br />assumed maintenance on the properties and paid for utilities and insurance using <br />General Funds without billing the Successor Agency or its predecessor. Since that is <br />the case, the City will not incur additional costs beyond what it is currently paying but <br />will be formally responsible for providing maintenance to the properties. The City has <br />general liability coverage for the Successor Agency and also maintains the property <br />insurance for the Courthouse Square, but the City may need to obtain property <br />insurance for the Library Parking Lot and the Maple, Lathrop and Elm Culvert Parcel. <br /> <br />If the transfer of the Library Parking Lot is approved, the City may set parking rates to <br />recover costs for operating the parking lot. The transfer of the culvert to the City may <br />result in operational efficiencies related to the maintenance and rehabilitation of the <br />Redwood Creek Culvert. The rescission agreement of the Courthouse Square <br />easement allows the City to continue to utilize the square as a public space as it has, so <br />an increase in costs is not anticipated. <br /> <br />ENVIRONMENTAL REVIEW <br />The recommended action is exempt from the requirements of the California <br />Environmental Quality Act (CEQA) as it does not have potential for causing a significant <br />effect on the environment. <br /> <br /> <br /> <br />CHRISTOPHER DACUMOS <br />MANAGEMENT ANALYST II <br /> <br />6.1.E. - Page 4
