<br />3 <br /> <br /> <br />ARTICLE 3 - UNION SECURITY <br /> <br />3.1 Union Representatives <br /> <br />A qualified representative of the Union shall be allowed to visit the work location for the purpose of <br />ascertaining whether or not this Agreement is being observed. This right shall be exercised reasonably. A <br />qualified representative of the Union shall report to management before proceeding to the work location. <br />He/She shall not interfere with the normal conduct of work. Activities such as the soliciting of membership, <br />collection of dues, holding membership meetings, campaigning for office, conducting elections and <br />distributing literature is strictly prohibited during working hours without the prior approval of the Personnel <br />Officer or his/her representatives. <br /> <br />3.2 Use of City Facilities <br /> <br />The Union may, with the prior notice to the Human Resources Manager, be granted the use of City facilities <br />for meetings of City workers provided space is available and does not interfere with City business. The use <br />of City equipment, other than items normally used in the conduct of meetings, is strictly prohibited. <br /> <br />3.3 Bulletin Boards <br /> <br />The Union may use portions of designated City bulletin boards in those areas which have workers in the <br />SEIU Unit for the purpose of posting notices of official Union business such as times and places of <br />meetings. The bulletin board may be used for lawful political or campaign notices. <br /> <br />3.4 Advance Notice <br /> <br />The Union shall be notified of any creation of or change to an ordinance, rule, resolution or regulation within <br />the scope of representation proposed to be adopted by the City Council, by any board or commission of the <br />City or by any department and the Union shall be given the opportunity to meet and confer or consult on the <br />impact of such ordinance, rule, resolution, or regulation prior to its adoption by the City Council, board or <br />commission of the City or any department. In cases of emergency when City management determines that <br />an ordinance, rule, regulation, or resolution must be adopted immediately, without prior notice or meeting <br />with the Union, the City shall provide the Union such notice and the opportunity to meet and confer or <br />consult on the impact of such ordinance, rule, resolution, or regulation at the earliest practical time following <br />the adoption of such ordinance, rule, resolution or regulation. <br /> <br />3.5 Availability of Data <br /> <br />The City shall make available to the Union such non-confidential information pertaining to employment <br />relations as is contained in the public records of the agency subject to the limitations and conditions set forth <br />in the Employer-Employee Relations Resolution adopted by the City Council on August 7,1972, and <br />Government Code Sections 6250 et seq. Such information shall be made available during regular working <br />hours in accordance with the City's rules and procedures for making public records available and after <br />payment of reasonable costs, if any, where applicable. <br /> <br />3.6 Unit Workers <br /> <br />The City shall supply the Union an electronic data report with the names, classifications, departments and <br />addresses (with the individual worker's consent) of all present and newly hired workers in the SEIU unit on a <br />6.3.B. - Page 13
