i. Escrow fees, recording charges, and title insurance charges <br />shall be paid by District. In the event that, for any reason, the <br />District does not proceed with financing and construction of school <br />facilities cn the School Site, any amounts paid into escrow shall be <br />returned to District, together with any interest earned thereon. <br />5. Prooerty Subiect to License. <br />City shall offer a license to District to enter upon and use the <br />remainder of the Sandpiper Joint Use Site other than the School Site, <br />and the facilities and improvements thereon, for the purposes, and <br />subject to the restrictions, as specified in this Joint Use Agreement. <br />The license shall be offered at the time that an offer to convey is made <br />pursuant to paragraph 4, above. Such license shall only become <br />effective if the District acquires title to the School Site, and shall <br />thereafter have a term coincident with the term of the Joint Use <br />Agreement. Such license shall be deemed a license coupled with an <br />interest. District shall not be required to pay additional compensation <br />for such license. <br />District shall offer a license to City to enter upon and use those <br />portions of the School Site that are not subject to the exclusive use of <br />District, and the facilities and improvements thereon, for the purpose, <br />and subject to the restrictions, as specified in this Joint Use <br />Agreement. The license shall be offered at the time that District takes <br />title to the School Site. Such license shall only become effective if <br />District acquires title to the School Site, and shall thereafter have a <br />term coincident with the term of the Joint Use Agreement.
