required to pay additional compensation for such license. <br />The licenses granted hereby do not constitute deeds, grants of <br />easement, leases or conveyances, or transfers of any property interest. <br />6. Use of Site for School Purposes. <br />The Sandpiper Joint Use Site may only be used by District, or its <br />successors in interest, for the construction and operation of a school, <br />pre-school and/or daycare facility, and/or such other uses as City and <br />District may mutually agree upon, and such related ancillary uses as are <br />customarily carried out by District on School property. City and <br />District hereby agree that the uses listed in Exhibit C, attached hereto <br />and incorporated herein by this reference, may be conducted on the Site <br />without further consent of City. In the event District desires to <br />conduct a use other than a school, pre-school or daycare facility, or a <br />use listed in Exhibit C, prior written consent shall first be obtained <br />from City. District shall be authorized to sublease its facilities on <br />the school Site as may be necessary or convenient to carry out an <br />approved use. District hereby covenants that it shall ensure that its <br />school facilities are maintained in use, on and after the date such <br />facilities become available for occupancy, with one or more of the <br />approved uses set forth in this paragraph, during the entire term of <br />this Agreement, except when such facilities become unavailable for <br />occupancy as a result of any one of the events set forth in paragraph <br />28, below. District further covenants that this restriction shall be <br />included in any financing documents for construction of school <br />facilities on the Joint Use Site.
