D. City has determined that the Sandpiper Park Property, if <br />augmented by the Egret Lane Property, would be an appropriate site for <br />joint use as a park and community center operated by City, and a school <br />facility operated by District, with each to share in the development, <br />use and maintenance of facilities and equipment to be constructed or <br />installed on the site. <br />E. City and District desire to enter into an agreement providing <br />for joint use of the Sandpiper Park Property and Egret Lane Property as <br />a City operated park and community center and a District operated school <br />site, and setting forth the conditions of such joint use. <br />F. City and District declare that it is their intent that joint <br />use of the Sandpiper Park Property and Egret Lane Property, in <br />accordance with the terms and conditions of this Joint Use Agreement, <br />shall continue in perpetuity unless terminated by mutual agreement of <br />the parties hereto. <br />NOW, THEREFORE, City and District agree as follows: <br />1. Purposes. <br />This agreement is entered into pursuant to the provisions of <br />Government Code §6500 et seq., to provide for the joint exercise of the <br />powers of the parties to construct, install, maintain, repair, replace <br />and operate public recreational and community service facilities and <br />appurtenances, and for the construction, installation, maintenance, <br />repair, replacement and operation of public school classroom <br />instructional and administration facilities ("School Facilities") by the <br />District. <br />2 <br />ATTY/AGR/2017/AMENDMENTS/AMEND NO. 1 TO JOINT USE AGREEMENT - SANDPIPER <br />REV: 03-02-17 JS Page 9 of 42 <br />
