Lisa Marie Lombardi - McNally requested the City adopt the amortization clause. Due to the <br />location of the store, she stated it is inappropriate. She expressed concern that her neighbors <br />had not been informed of the hearing. <br />Raymond DeNardi, the property owner, not affiliated with the business stated any premise <br />could duplicate the business by using the Internet. Has stated he has heard no complaints <br />from Sequoia High School, the Police Department or the neighbors. He voiced concern <br />with the 6 months amortization period, urging grandfathering of the store or at least an <br />attempt to work a compromise. He requested adjustment of the amortization period to the <br />length of the lease. <br />M/S Ira/Jordan to the close the public hearing. The motion passed by a unanimous voice <br />vote. <br />M/S Hartnett/Ira to reagandize the issue for a decision at the time that is subsequent to the <br />time that further legal advice is attained from the City Attorney on amoritization issues and <br />any related issues. Not included in the motion is the discussion of terms or conditions with <br />the property owner or store owner. The motion passed by a unanimous voice vote. <br />D. Relocation Guidelines: <br />Development Services Manager LaTorra explained the focus of the presentation is two -fold. One is <br />to clarify code enforcement actions such as the recently adopted code enforcement actions, namely <br />a compliance order, would trigger relocation assistance. Secondly, to match up this relocation <br />guideline to reflect the recent change in the State law. The State law pertains to posting <br />requirements for properly noticed tenants. <br />M/S Ira/Hartnett to adopt RESOLUTION 13861 AMENDING RELOCATION GUIDELINES <br />IMPLEMENTING CHAPTER 42 OF THE CODE OF THE CITY OF REDWOOD CITY TO <br />ADD THE USE OF A COMPLIANCE ORDER TO ENFORCEMENT ACTIONS, AND <br />DEFINITIONS AND TO PROVIDE FOR NOTIFICATION PROCEDURES AND APPEAL <br />PERIODS.
