Community Development Services Manager Passanisi began with the size of the unit. <br />Currently 640 square feet is a requirement and the Planning Commission recommends no <br />change. Regarding the owner occupancy of the dwelling unit, the Planning Commission <br />recommends the property owner may reside in the main unit or the second unit. Currently, the <br />ordinance requires that the owner occupies only the main unit. A major change would be the <br />requirement of a conditional use permit which would occur every time the City approves a <br />second unit and there would be a formal hearing and notice of surrounding property owners. <br />Another significant recommendation is in addition to the required 3 parking spaces for the main <br />unit and accessory dwelling unit. The proposed change would require that one of the spaces be <br />in the driveway and be called tandem parking. Community Development Services Manager <br />Passanisi further explained and showed slides of the proposed application. <br />Building Inspector Bill Tott explained the garage conversions and accessory units being broken <br />into four main categories. He proceeded to show various examples throughout the City. <br />Council asked various questions regarding carport requirements. <br />There are only 20 -30 second units created since 1991 under the legal units ordinance (granny <br />units ordinance). There are a number of legal non - conforming units and approximately 530 <br />units are reported and pay taxes to the assessor's office. An estimate is that there are <br />approximately 2,000 units without permits, some separate units and some garage conversions. <br />8:55 p.m. — Opened Public Hearing <br />Kathleen Mahany asked consideration of studying a minimum of 640 square feet and a <br />maximum of 750 square feet depending on setback and zoning requirements, as a help to <br />seniors. She asked that the Planning Department and the HHCC get together and find out a <br />creative way to allow seniors with garages in front of their house to solve the parking problem. <br />Michael Verdone, Planning Commission Chairperson, reported on actions taken and reasons. <br />He explained 3 changes, one being the conditional use permit for notification and review of <br />plans. Another recommendation is that the owner be able to live in either unit. The third and <br />most difficult area is parking and the Commission allowed for tandem parking within the <br />setback requirements. There are alternatives, beginning with the General Plan, such as higher <br />density with smaller lots, mixed use, the proposed theatre complex with a housing element, and <br />the Pacific Shores proposal for housing are examples. <br />Jack Anthony commented on the statements of Ms. Mahany.
