Jim Bigelow excited about the opportunity to construct second units and encouraged adoption <br />of the ordinance separately from the second item. <br />Geri Mayers asked for clarification on use permit requirements if assisted living is required <br />outside of the residence and stated health and safety is a priority. <br />Janet Borgens commented positively on consideration toward seniors and asked whether the <br />use permit stands after being approved even if the applicant moves out. <br />9:30 p.m. — Closed the Public Hearing <br />Consensus to come back to Council in a reasonably short period time, staff to bring text that <br />limits the meaning of the conditional use permit to see an option toward a discretionary permit <br />that includes the notification of neighbors, but not have the legal impact of a use permit. City <br />Attorney to come back with an analysis of the legal impact of such a conditional use permit. <br />The parking in tandem continue to be a part of the report coming back. Staff come back with an <br />option to not include the 15 -ft. setback. Staff analysis of how to contain the potential ripple <br />affect. Options about the size of the second unit (possibly up to 750 sq. ft.) and the option of a <br />percentage and its effects on very large lots. Look at what other cities do to monitor impact in <br />particular areas. Staff consider what real limits exist regarding tandem parking. Evaluate six <br />month report back feasibility and whether realistically staff can enforce. <br />10:17 —10 :30 p. m. - Recess <br />H. Illegal Second Units, and Illegal Garage Conversions, Code Enforcement Approach and <br />Administrative Citations (No Legal Advertisement Required for this item, but incorporated <br />as a part of the Changes to Accessory Dwelling Unit report); <br />Terry Stewart stated his issue was initially the carports he stated he would like to see stronger <br />amendments pertaining to conversions regarding the fire safety and ripple effect. <br />Bob Diaz spoke of the parking issues and stated code enforcement needs the tools to address the <br />existing situations. <br />Pete Hughes stated it is an important subject and should be discussed in greater detail at a later <br />meeting. He suggested utilizing either the San Carlos or Daly City customer friendly model. <br />Jim Bigelow stated that in appraisals for lending purposes, illegal accessory dwelling units are not <br />considered. <br />Council discussion included consideration of an inventory being needed in order for a law to be <br />applied fairly. Health and safety issue should be considered.
