REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />March 27, 2017 <br /> <br />SUBJECT <br />Certificate of Compliance Ordinance <br /> <br />RECOMMENDATION <br />Waive First Reading and Introduce an Ordinance Establishing a Certificate of <br />Compliance Process within Redwood City Municipal Code Chapter 30 (Subdivisions) <br /> <br />BACKGROUND <br />Redwood City Municipal Code Chapter 30 (Subdivisions) established the regulations <br />requirements for the design and improvement for land subdivision within the City. The <br />Subdivision Ordinance controls the preparation of maps (parcel, tentative, and final <br />maps), design standards for lot creation, establishment of condominiums, and park <br />dedications (through implementation of the Quimby Act), among other provisions. The <br />intent of the Subdivision Ordinance is to be consistent with the goals, policies, and <br />programs of the General Plan and spirit and intent of the State of California Subdivision <br />Map Act (Government Code 66410- 66499.58). <br /> <br />The Subdivision Map Act includes a requirement for preparation of a Certificate of <br />Compliance, a legal document that certifies that a parcel of land complies with the <br />Subdivision Map Act. In general, the Subdivision Map Act prohibits the sale, lease, or <br />financing of any parcel of land that has not been created in compliance with the <br />applicable subdivision regulations at the time it was created. The Certificate of <br />Compliance is a tool to inform title companies, lenders and the public that parcels <br />comply with state and local subdivision laws. In most cases involving land divisions, an <br />approved Parcel Map or Final Map represents a Certificate of Compliance. <br /> <br />In other cases where a map is not created, such as lot line adjustments or verification of <br />the current legal status of existing lots, a Certificate of Compliance document <br />demonstrating compliance may be created and recorded with the property. The process <br />to prepare and create a Certificate of Compliance is described in Section 66499.35 of <br />the Subdivision Map Act. However, many jurisdictions choose to establish the process <br />within their subdivision ordinances in a manner to have local control of the process <br />while maintaining consistency with state law.
