Certificate of Compliance process. Instead, landowners have historically relied upon the <br />Subdivision Map Act for the requirements and process. <br /> <br />ANALYSIS <br />City staff recommends the establishment of Article XIII, Certificate of Compliance, to <br />Chapter 30 (Subdivisions) of the Municipal Code (Attachment 1). This article would be <br />consistent with the Subdivision Map Act, and would further define the Redwood City <br />process to create a Certificate of Compliance, including the following: <br /> <br />· Application to the Planning Manager, who will ultimately determine whether or <br />not the parcel in question complies with the Subdivision Map Act and Redwood <br />City Chapter 30 (Subdivisions), including the requirements of Article XIII <br />(Certificate of Compliance); <br />· Submittal requirements, established by Article XIII and the Planning Manager, <br />and fee, established by the City Council; <br />· Timeline for the Planning Manager’s response to the submitted application; <br />· Process for issuing a Certificate of Compliance, including noticing, and <br />recordation with the county recorder’s office, and <br />· Appeals of the decision by the Planning Manager, Community Development <br />Director, or Subdivision committee, whichever is applicable, to the Planning <br />Commission, or, for actions taken by the Planning Commission, to the City <br />Council. <br /> <br />Article XIII would also describe the process for issuance of a conditional certificate of <br />compliance that may impose conditions upon properties found to be not compliant with <br />the Subdivision Map Act at the time the applicant acquired interest in the property <br />(subject to conditions). <br /> <br />Establishment of this ordinance and the requirements and process described therein <br />would provide the City with the tools to implement the Certificate of Compliance <br />provisions of the Subdivision Map in a manner consistent with Article 30 and through a <br />specific, locally defined process. <br /> <br />ALTERNATIVES <br />1. Do not adopt the ordinance and request additional study and/or ordinance <br />revisions by staff. <br /> <br />FISCAL IMPACT <br />Establishing the ordinance would not result in any additional direct City staff costs, in <br />that staff already follows the process provided in the Subdivision Map Act for <br />subdivision compliance. The establishment of the fee as provided in the ordinance may <br />offset any additional staff costs, including costs for noticing. <br />8.C. - Page 2
