Certificate of Compliance process. Instead, landowners have historically relied upon the
Subdivision Map Act for the requirements and process.

ANALYSIS
City staff recommends the establishment of Article XIII, Certificate of Compliance, to
Chapter 30 (Subdivisions) of the Municipal Code (Attachment 1). This article would be
consistent with the Subdivision Map Act, and would further define the Redwood City
process to create a Certificate of Compliance, including the following:

· Application to the Planning Manager, who will ultimately determine whether or
not the parcel in question complies with the Subdivision Map Act and Redwood
City Chapter 30 (Subdivisions), including the requirements of Article XIII
(Certificate of Compliance);
· Submittal requirements, established by Article XIII and the Planning Manager,
and fee, established by the City Council;
· Timeline for the Planning Manager’s response to the submitted application;
· Process for issuing a Certificate of Compliance, including noticing, and
recordation with the county recorder’s office, and
· Appeals of the decision by the Planning Manager, Community Development
Director, or Subdivision committee, whichever is applicable, to the Planning
Commission, or, for actions taken by the Planning Commission, to the City
Council.

Article XIII would also describe the process for issuance of a conditional certificate of
compliance that may impose conditions upon properties found to be not compliant with
the Subdivision Map Act at the time the applicant acquired interest in the property
(subject to conditions).

Establishment of this ordinance and the requirements and process described therein
would provide the City with the tools to implement the Certificate of Compliance
provisions of the Subdivision Map in a manner consistent with Article 30 and through a
specific, locally defined process.

ALTERNATIVES
1. Do not adopt the ordinance and request additional study and/or ordinance
revisions by staff.

FISCAL IMPACT
Establishing the ordinance would not result in any additional direct City staff costs, in
that staff already follows the process provided in the Subdivision Map Act for
subdivision compliance. The establishment of the fee as provided in the ordinance may
offset any additional staff costs, including costs for noticing.
8.C. - Page 2
