ATTY/ORD.441/AMENDING CHAPTER 30 OF THE MUNICIPAL CODE (CERTIFICATE OF COMPLIANCE) <br />REV: 03-02-17 VR <br />Page 1 of 3 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY AMENDING CHAPTER 30 (SUBDIVISIONS) OF THE MUNICIPAL <br />CODE BY ADDING A NEW ARTICLE XIII (CERTIFICATE OF <br />COMPLIANCE) THERETO AND AMENDING SECTION 30.68 <br />(APPEALS; ADVISORY AGENCY) <br />NOW, THEREFORE, THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS <br />FOLLOWS: <br /> <br />SECTION 1. Chapter 30 of the City Municipal Code is amended by adding the <br />following as Article XIII: <br /> <br />“ARTICLE XIII. CERTIFICATE OF COMPLIANCE <br /> <br />Sec. 30.150. CERTIFICATE OF COMPLIANCE PROCESSING; GENERAL: <br />A. Any person owning real property or a vendee of such person pursuant <br />to a contract of sale of such real property may submit to the Planning <br />Manager an application for issuance of a Certificate of Compliance, and <br />the Planning Manager shall determine, whether such real property <br />complies with the provisions of this article and the Subdivision Map Act <br />(California Government Code Section 66410 et. seq., as may be <br />amended). The application shall include all information reasonably <br />necessary to allow the Planning Manager to evaluate whether the real <br />property so complies, including documentation of any prior subdivision <br />approvals, a separate chain of title report for each individual lot, and any <br />other information reasonably requested by the Planning Manager. <br />Within 30 days of application submittal and fee payment, the Planning <br />Manager shall determine whether an application is complete. If an <br />application is incomplete, the Planning Manager shall provide written <br />notification to the applicant listing the information or fees necessary to <br />complete the application. If the Planning Manager determines that such <br />real property complies with the provisions of this chapter and the <br />Subdivision Map Act, he or she shall issue a certificate of compliance. <br />Upon making such a determination, the Planning Manager shall cause <br />a certificate of compliance to be filed for record with the county recorder. <br />The certificate of compliance shall identify the real property and shall <br />state that the division thereof complies with applicable provisions of this <br />chapter and the Subdivision Map Act. <br /> <br />B. If the Planning Manager determines that such real property does not <br />comply with the provisions of this chapter or the Subdivision Map Act, <br />he or she shall issue a conditional certificate of compliance, which may <br />impose such conditions as would have been applicable to the division of <br />the property at the time the applicant acquired his or her interest therein, <br />8.C. - Page 4
