REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />April 3, 2017 <br />SUBJECT <br />Hearing to determine whether the buildings located at 112-120 Vera Avenue are a <br />public nuisance that should be ordered abated through reconstruction and repair or <br />razing and removal <br /> <br />RECOMMENDATION <br />Adopt a Resolution declaring the buildings located at 112-120 Vera Avenue to be a <br />public nuisance and directing the owner to abate such nuisance within thirty days by <br />having the buildings properly reconstructed or repaired or by having the buildings razed <br />and removed; direct the Building Inspector to take all necessary steps to prepare for <br />razing and removing the buidings in the event the property owner chooses not to abate <br />such nuisance; and find that the abatement order is exempt from the requirements of <br />the California Environmental Quality Act (CEQA) under the CEQA Guidelines Section <br />15321 (Enforcement Actions by Regulatory Agencies) as set forth in the staff report <br /> <br />BACKGROUND <br />Property Background <br /> <br />The subject property, 112-120 Vera Avenue (APN # 053-064-130) is located near the <br />corner of El Camino Real and Vera Avenue. The property has five one-story <br />duplexes, totaling ten units. Each unit has one bedroom and one bath with an <br />attached one-car garage. <br /> <br />Although the property owner appears to have lived in one of the units on a periodic <br />basis, he has chosen not to rent or lease any of the other units for some time. City <br />utility records indicate water was disconnected on October 30, 2001 for most of the <br />units. Other than the property owner’s unit, it is assumed that the property has been <br />mostly vacant and unoccupied since that time. <br /> <br />Unfortunately, these vacant units regularly attract squatters. Broken windows are <br />often scattered around the property, the rear fence is dilapidated, and the exterior <br />stucco walls are cracking and covered with graffiti. The structural integrity of the units <br />is also compromised due to the roof being in disrepair and the foundation showing <br />signs of cracking. The rear property line abuts an adjacent alley way. The rear and <br />front side yard area is littered with debris, garbage and human feces. Staff believes <br />the property constitutes a public nuisance in need of abatement. <br /> <br />Complaint and Violation Background <br />7.B. - Page 1
