<br />The Code Enforcement Division first received a complaint about 112-120 Vera <br />Avenue on February 5, 2015. The complaint listed the following issues: <br /> <br />· The multi-unit property had been vacant for years; <br />· The fence in the alley at the rear of the property was completely fallen over <br />and broken; <br />· There was a mattress dumped by the alley; <br />· There was graffiti all over the building and fence in the alley; and <br />· People were constantly loitering and trespassing on the property. <br /> <br />A February 13, 2015 inspection confirmed that the property was vacant and had <br />multiple code violations for trash, debris, a broken fence, uninhabitable units and <br />graffiti. After re-inspection on February 19, 2015, Code Enforcement posted a <br />Courtesy Notice of Violation on the property along with a letter listing corrective <br />action that needed to be taken by February 23, 2015. Between February-May 2015, <br />Code Enforcement posted two more Notices of Violation at the property. No <br />corrective action was taken. <br /> <br />On January 12, 2016, Building Inspection and Code Enforcement staff inspected the <br />property again. The inspectors observed broken windows through which people had <br />entered into the vacant units to sleep with no running water, heat or electricity. Human <br />feces were found in the rear yard and graffiti was all over the building. Debris, junk and <br />trash were found in the side and rear yards and fences had collapsed and fallen onto <br />the property. As staff was leaving the property, the property owner arrived on site. Staff <br />attempted to discuss possibility of getting the property owner assistance in remediating <br />the code violations but the property owner was not receptive to the offer. <br />Due to non-compliance with the 2015 Notices of Violation, Code Enforcement staff sent <br />the property owner a Final Notice of Violation on January 13, 2016. The Final Notice of <br />Violation stated: <br />1. Dilapidated and fallen fences along alley and side yard fencing El Camino <br />Real, unsecured living units, human excrement in side yard, mattresses and <br />other junk and debris stored in the rear and side yards (visible to the public), <br />inoperable vehicle, broken windows and graffiti. RCC 14.73 states that it is a <br />violation to act in any way or to maintain any site to create a menace or in any <br />way to endanger the public health. <br />2. Multiple unsafe living units. RCC 9.60 (ANY VIOLATION OF ARTICLE – <br />HOUSING CODE) – Establishes and defines a violation to use or occupy or <br />maintain any living space or unit that does not meet the minimum code <br />requirement for living space (heating, space, sanitation, light, ventilation, etc.) <br />3. Multiple broken windows. RCC 9.3 IPMC 304.13.1 states that it is a violation <br />to maintain cracked or multiple broken windows at any premises. <br /> <br /> <br />7.B. - Page 2
