<br />ATTY/RESO.0031/ CC RESO ADOPTING DENIAL OF APPEAL BY REDWOOD CITY RESIDENTS FOR RESPONSIBLE DEVELOPMENT <br />REV: 03-30-17 PR <br />Page 2 of 22 <br />WHEREAS, on November 1, 2016, the Planning Commission considered an Initial <br />Study checklist and its findings prepared by the City's Planning Division, the previously <br />certified Downtown Precise Plan Program Environmental Impact Report (EIR) (State <br />Clearinghouse #2006052027), the staff reports, oral and written, and testimony and <br />materials presented by all those wishing to be heard on this Project at the noticed public <br />hearing on this matter; and <br /> <br />WHEREAS, pursuant to Section 2.0.3.A.2.a of the DTPP (pg. 28), approval <br />authority is vested in the Planning Commission since the development is a “Large <br />Project;” and <br /> <br />WHEREAS, on November 1, 2016 and on January 17, 2017, the Planning <br />Commission conducted public hearings in accordance with all applicable requirements of <br />the Subdivision Map Act, and the Redwood City Municipal Code and Zoning Ordinance, <br />to consider the Downtown Planned Community Permit DPC2015-12 including two (2) <br />guideline deviations, Tentative Parcel Map TM2015-09, and the Affordable Housing Plan, <br />along with all applicable requirements of the State Planning and Zoning Law, the <br />Downtown Precise Plan, and the recommendations of the AAC; and <br /> <br />WHEREAS, the applicant modified the application pursuant to concerns raised by <br />the Planning Commission, converting 4,500 sq. ft. (of the 5,900 sq. ft.) of ground floor <br />retail into four residential units with entry stoops, lowering the height of the southern <br />building corner by one story, and changing the colors, materials, articulation, and roof <br />form of the southern building element; and <br /> <br />WHEREAS, at the January 17, 2017 public hearing, the Planning Commission <br />ultimately supported the Project, as revised, with the added condition that the ground <br />floor unit at the southern corner at El Camino Real and the alley be converted back to <br />retail, and determined that the proposed Downtown Planned Community Permit including <br />two (2) guideline deviations, Tentative Map, and Affordable Housing Plan would further <br />the purposes of and appropriately implement the City of Redwood City General Plan, <br />applicable provisions of the Redwood City Municipal Code and Downtown Precise Plan, <br />and the 1409 El Camino Real project, and approved the Project; and <br /> <br />WHEREAS, an appeal was filed with the City during the 15-day appeal period by <br />Kris Johnson on behalf of Redwood City Residents for Responsible Development <br />(Appellant) challenging the Planning Commission’s approval of the Project; and <br /> <br />WHEREAS, the matter was duly noticed for a de novo public hearing before the <br />City Council on April 3, 2017; and <br /> <br />8.A. - Page 34
