<br />ATTY/RESO.0031/ CC RESO ADOPTING DENIAL OF APPEAL BY REDWOOD CITY RESIDENTS FOR RESPONSIBLE DEVELOPMENT <br />REV: 03-30-17 PR <br />Page 3 of 22 <br />WHEREAS, on April 3, 2017 the City Council conducted a duly noticed de novo <br />public hearing in accordance with all applicable requirements of the Subdivision Map <br />Act and the Redwood City Municipal Code, all applicable requirements of the State <br />Planning and Zoning Law, the City Zoning Ordinance and the Downtown Precise Plan, <br />to consider the appeal of the Planning Commission’s approval of the Project, and <br />received and considered oral and documentary evidence on the appeal and application; <br />and <br /> <br />WHEREAS, the City Council considered the Initial Study checklist prepared by <br />the City's Planning Division and its findings, the previously certified Downtown Precise <br />Plan Program EIR (State Clearinghouse #2006052027), and the entire record of the <br />administrative proceedings regarding the adoption of the Downtown Precise Plan <br />(including without limitation the Mitigation, Monitoring and Reporting Plan attached <br />to Resolution No. 15086 adopted on January 24, 2011), as well as the entire record <br />of administrative proceedings regarding the adoption of the General Plan; and <br /> <br />WHEREAS, the City Council determined that the proposed Downtown Planned <br />Community Permit including two (2) guideline deviations, Tentative Map, and Affordable <br />Housing Plan would further the purposes of and appropriately implement the City of <br />Redwood City General Plan, the Downtown Precise Plan, and applicable provisions <br />of the Subdivision Map Act, the Redwood City Municipal Code and Zoning <br />Ordinance. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF REDWOOD CITY AS FOLLOWS: <br /> <br />Section 1. The City Council, having independently heard, considered and weighed <br />all the evidence in the record, including evidence presented by City staff, the Applicant, <br />the Appellants and members of the public, and being fully informed of the Project, the <br />Planning Commission’s decision, and the appeal, finds that the Appellant has not shown, <br />based on evidence in the record, that the Planning Commission’s decision was made in <br />error, that there was an abuse of discretion by the Planning Commission, that the <br />Planning Commission’s decision was otherwise improper, or that the City’s notices, <br />agendas, and appeal procedures were unlawful in any manner, and, in the exercise of <br />its independent judgment, hereby denies the appeal and approves the Downtown <br />Planned Community Permit including two (2) guideline deviations, Tentative Map, <br />Affordable Housing Plan based on the following findings and subject to the Conditions of <br />Approval set forth below. This determination is based on the entire record, including <br />without limitation the application materials, the DTPP, 2011 DTPP EIR, the entire record <br />of the administrative proceedings regarding the adoption of the DTPP, the General Plan, <br />the staff reports and attachments prepared for the Planning Commission hearing on the <br />8.A. - Page 35
