<br /> DCB:rks 6/28/84R <br /> DCB:sh 8/06/84R <br /> DCB: sh 8/17/84R <br /> DES:sh 10/25/84R <br /> DES:sh 11/26/84R <br />with all orders, permits, and directions of any agency of Grantor <br />having jurisdiction over its acts or defaults under the <br />franchise, and for the payment by Grantee of any claims, liens <br />and taxes due Grantor which arise by reason of the construction, <br />operation or maintenance of Grantee's CATV System. The security <br />fund may be assessed by Grantor for purposes including, but not <br />limited to, the following: <br /> (i) Failure of Grantee to pay Grantor sums <br /> due under the terms of the franchise; <br /> (ii) Failure of Grantee to reimburse Grantor <br /> for costs borne by Grantor to correct franchise <br /> violations and not corrected by Grantee, after <br /> due notice; <br /> (iii) Monetary remedies assessed against <br /> Grantee due to default or violation of <br /> franchise obligations; <br /> ( 2) Within thirty (30) days after notice to it that <br />any amount has been withdrawn by Grantor from the security fund <br />pursuant to the provisions of this subdivision, Grantee shall <br />deposit a sum of money sufficient to restore such security fund <br />to the original amount. <br /> (3 ) If Grantee fails, within ten (10 ) days following <br />written notice, to pay to Grantor any franchise fee or taxes that <br />are due and unpaid; or fails to pay to Grantor within such ten <br />(10) days, any monies, costs or expenses which Grantor is <br />obligated to pay by reason of any act or default of Grantee in <br />connection with this franchise; or fails, within thirty (30 ) days <br /> 12 <br /> .......-...,..... <br />
