11/5/81R <br />in a way safe for the particular type of fireworks remaining. <br />"'Section 78.104 (a) It shall be unlawful for any person <br />(including associations, corporations, clubs or other organizations) <br />to possess, store, offer for sale, expose for sale, or sell at <br />wholesale or retail any fireworks except pursuant to a temporary <br />fireworks sales permit issued hereunder by the Chief. <br />"'(b) The Chief shall have the authority to adopt.reasonable <br />rules and regulations for the granting of temporary fireworks <br />sales permits, and such permits shall include such reasonable <br />conditions and requirements as., in the opinion of the Chief, <br />are necessary or proper to eliminate hazard to property or <br />danger to any person. <br />"'(c) Temporary fireworks sales permits shall permit only <br />the sale of 'safe and sane' fireworks (as that term is defined in <br />§12504 of the Health and Safety Code of the State of California). <br />Such permits permitting sales at retail shall permit such sales <br />only during the period which such fireworks may be sold or <br />offered for sale at retail pursuant to Section 12703 of the <br />Health -and Safety Code of the State of California. <br />"'(d) The person applying for.a temporary fireworks sales <br />permit shall, at the time of application, submit for inspection <br />the applicant's license issued by the State Fire Marshall, and <br />(if applicable) furnish proof of coverage of such compensation <br />insurance as is required by the State of California for any <br />employees of the applicant. The applicant shall file with <br />the Chief a bond issued by an authorized surety insurance company <br />approved by the City, conditioned upon the applicant's payment, <br />in at least the minimum amounts hereinafter set forth, of all <br />damages to persons or property, including loss of life and loss <br />-18- <br />
