<br />" (b) Within ten (10 ) days after a determination of <br />the County Hearing Officer has been made in support of denial, <br />suspension or revocation of any permit, the applicant or <br />permittee may appeal such determination to the City Council. <br />Upon the filing of such appeal, the City Clerk shall <br />set a time and place for hearing and shall notify the appellant <br />thereof. The hearing shall be set within thirty (30) days <br />after the request is filed. At the hearing the appellant and <br />other interested persons may present evidence in opposition to <br />or in support of the appellant's case. At the conclusion <br />of the hearing, the City Council shall either grant or deny <br />the appeal, and the decision of the City Council shall be final. <br /> "ARTICLE II. FOOD ESTABLISHMENTS <br /> "DIVISION 1. DEFINITIONS <br />"Section 13.10. Definitions. The following words and <br />phrases shall for the purpose of this Article have the mean- <br />ings respectively ascribed to them in this Section. <br />" (a) Food Establishment. The term 'food establishment' <br /> includes all 'restaurants' as defined in Section <br /> 28522 of the California Health and Safety Code, <br /> all 'itinerant restaurants' as defined in Section <br /> 28523 of the California Health and Safety Code <br /> all 'vehicles' as defined in Section 28524 of the <br /> California Health and Safety Code, all 'vending <br /> machines' as defined in Section 28525 of the <br /> California Health and Safety Code, all 'retail <br /> food production and marketing establishments' as <br /> defined by Section 28802 of the California Health <br /> and Safety Code, and all 'bakeries' as defined <br /> by Section 28190 of the California Health and <br /> Safety Code. <br />" (b) Restaurant. The term 'restaurant' shall have the <br /> same meaning as that defined in Section 28522 of <br /> the California Health and Safety Code and in <br /> Section 5522.2 of the San Mateo County Ordinance Code. <br />" (c) Itinerant Restaurant. The term 'itinerant restaurant' <br /> shall have the same meaning as that defined in <br /> Section 28523 of the California Health and Safety <br /> Code, but shall not include mobile food vendors, <br /> as hereinafter defined. <br />" (d) Mobile Food Vendors. The term 'mobile food vendor' <br /> shall include all persons, corporations or entities <br /> which sell food or food products at retail to the <br /> public either from vehicles or from manually mobile <br /> containers.
