LSA will respond to the checklist questions regarding tribal cultural <br />resources. In addition, as part of this section, LSA will assist the City with consultation tasks pursuant <br />to Assembly Bill 52 (AB 52). AB 52, which became law January 1, 2015, now requires that local and <br />State agencies formally consult with recognized California Native American Tribes during the CEQA <br />process. Prior to the release of a Negative Declaration, Mitigated Negative Declaration, or <br />Environmental Impact Report, lead agencies must initiate consultation with tribes that are <br />traditionally and culturally affiliated with the geographic area of the proposed project if: (1) the <br />tribe requests, in writing, to be informed through formal notification of proposed projects in the <br />geographic area that is traditionally and culturally affiliated with the tribe; and (2) the tribe <br />responds, in writing, in 30 days of receipt of the formal notification of a proposed project and <br />requests consultation with the City (Public Resources Code Section 21080.3.1(b)). If the City has not <br />received a request from a tribe to be notified of projects pursuant to AB 52, consultation is not <br />required. However, should such a request be received, LSA can assist with Native American <br />consultation requirements, pursuant to AB 52. <br /> <br />2. Screencheck Draft Initial Study <br />LSA will amend the Administrative Draft Initial Study based on a single set of consolidated non‐ <br />contradictory comments provided to LSA by City staff. At this time, based on the preliminary analysis <br />included in the Administrative Draft Initial Study, LSA and City staff will confirm the topics to be <br />focused out of the EIR analysis and determine if any changes to the proposed work program are <br />warranted. <br /> <br />A digital version of the Screencheck Draft Initial Study will be provided to the City to verify that all <br />requested changes have been made and all appendix materials, references, and final graphics are <br />acceptable. We have allotted time for responding to changes; however, if this task exceeds the cost <br />allotted in the budget due to changes in project description or requests for additional analysis that <br />are not necessary to prepare a legally‐adequate document, a budget adjustment may be required. <br /> <br />3. Public Review Draft Initial Study <br />Final changes to the Screencheck Draft Initial Study will be made based on minor comments from <br />the City. The Initial Study would be circulated with and as an appendix to the EIR (refer to Task C.6, <br />below). <br /> <br />TASK C. ENVIRONMENTAL IMPACT REPORT <br />Based on LSA’s review of the IHSP Draft EIR and preliminary review of the proposed project and <br />existing site conditions, LSA believes that the following environmental issue topics will require <br />detailed review in the EIR: land use and planning; biological resources; cultural resources; transpor‐ <br />tation and circulation; air quality; noise; hazards and hazardous materials; hydrology and water <br />quality; and utilities and service systems.
