<br /> CGM:sw:4/24/78R <br />the Commission of the time and place of the hearing thereon. <br />The City Clerk shall, in every case, notify the Planning <br />Department of such appeal upon receipt of a request therefor. <br /> "A public hearing shall be held upon the appeal. Notice <br />of such public hearing shall be given, to the extent not <br />inconsistent herewith, in accordance with the provisions of <br />Article 49 of the Zoning Ordinance. <br /> "The Planning Commission, or the City Council, as the <br />case may be, may affirm, reverse or modify the decision, <br />determination, or action being appealed if it determines the <br />public interest will be served by such affirmance, reversal <br />or modification, and if it makes those findings required by <br />Section 30.137 if such findings are applicable for a particular <br />appeal. The Council may, pending final determination of any <br />appeal, require the Planning Commission or any administrative <br />official to submit its or his recommendations to the Council. <br />The determination on an appeal by the City Council shall be <br />final." <br />SECTION 2. The sections, subsections, sentences, clauses and <br />phrases of the article enacted hereby, and of this ordinance, are <br />hereby declared severable, and if any section, subsection, sentence, <br />clause, or phrase of said article or ordinance shall be adjudged <br />or declared unconstitutional or otherwise invalid as contrary to <br />law by a valid judgment or decree of a Court of competent juris- <br />diction, such unconstitutionality or invalidity shall not affect <br />any of the remaining sections, subsections, sentences, clauses or <br />phrases of said article or ordinance. <br />SECTION 3.
