REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />June 12, 2017 <br /> <br />SUBJECT <br />Second Reading of the Ordinance to Establish the Certificate of Compliance Process <br /> <br />RECOMMENDATION <br />Waive the Second Reading and Adopt the Ordinance to Establish the Certificate of <br />Compliance Process within Redwood City Municipal Code Chapter 30 (Subdivisions) <br /> <br />BACKGROUND <br />On March 27, 2017, the City Council introduced and unanimously approved (5-0 with <br />Councilmember Bain and Councilmember Aguirre absent) an ordinance to the Redwood <br />City Municipal Code Chapter 30 (Subdivisions) to establish a Certificate of Compliance <br />process. The March 27 staff report describing the Certificate of Compliance process is <br />attached to this report. <br /> <br />ANALYSIS <br />The Certificate of Compliance process contained in the Final Ordinance (Attachment 1) <br />would be consistent with the Subdivision Map Act (SMA) and would define the Redwood <br />City process to create a Certificate of Compliance (or Conditional Certificate of <br />Compliance) upon request by property owners. The ordinance describes the application <br />submittal requirements, timeline for review, compliance review with the SMA and <br />Chapter 30, recordation process, and appeal procedures. <br /> <br />If adopted, this ordinance will be effective 30 days from this action (July 12, 2017). <br /> <br />ALTERNATIVES <br />1. Reintroduce the ordinance with changes, which could also require additional <br />environmental review. <br />2. Do not adopt the ordinance. <br /> <br /> <br />FISCAL IMPACT <br />No fiscal impact is expected because of this recommended action. On May 8, 2017, the <br />City Council established a Certificate of Compliance application fee of $1,185.00 as part <br />of the Community Development Fee amendment ordinance. When this fee becomes <br />effective (July 22, 2017), it is intended to substantially recover staff costs associated <br />with each Certificate of Compliance request. <br />6.4.A. - Page 1
