DELIVERIES; DISTANCE; EXTENSION OF TIME <br />"Delivery" is defined as complete delivery of equipment, materials, vehicles or supplies free <br />and clear from any and all defects, claims, debts or demands whatsoever to Redwood City <br />Fire Department, 755 Marshall Street, Redwood City, CA 94063. <br /> <br />The Bidder’s Bid Submission will specify the maximum number of days till delivery to <br />Redwood City, example: 60 days from the date the City mails the purchase order to the <br />successful Bidder. Date ranges are not allowed, example: 90-120 days from the date the City <br />mails the purchase order to the successful Bidder. <br /> <br />In the event the equipment has not been delivered to Redwood City Fire Department (755 <br />Marshall Street, Redwood City, CA 94063) within the specified maximum number of days till <br />delivery to Redwood City, the contract between the successful Bidder and the City may be <br />considered null and void. <br /> <br />Applications for extension of time beyond the specified maximum number of days till delivery <br />to the Redwood City Fire Department shall be made in writing to the City Contact not more <br />than 7 calendar days from the beginning of any condition, which will cause delay. Allowances <br />will be made for delays of delivery due to strikes, fires, floods or other causes not due to the <br />fault or negligence of the Bidder. <br /> <br />In the event a successful Bidder fails to provide the equipment within the time specified and <br />the contract is canceled, the City may enter into an agreement with the next lowest Bidder <br />for delivery of the specified equipment in this document. <br /> <br />13. ERRORS AND OMISSIONS <br />The Bidder will not be allowed to take advantage of any error or omission in their Submitted <br />Bid. <br /> <br />14. FEDERAL AND STATE TAXES <br />The prices bid shall include any Federal tax, exclusive of Federal Excise Tax heretofore <br />imposed by Congress, which is applicable to the material to be furnished. If any sales tax, <br />processing tax, adjustment charge or other taxes or charges are imposed or changed by <br />Congress after the date set for opening bids and made applicable directly upon the <br />production, manufacture or sale of the supplies to be furnished, and are paid by the <br />Successful Bidder on the equipment furnished, then the prices stated in the schedules will <br />be increased or decreased accordingly, and any amounts due the Successful Bidder as the <br />result of such changes will be charged to the City and added on vouchers (or invoices) as <br />separate items. <br /> <br />15. PAYMENTS <br />Payment will be made promptly following delivery, inspection, and acceptance of goods by <br />the Redwood City Fire Department and receipt of invoice. <br /> <br />16. BIDDER’S STATEMENT <br />If awarded the contract, the undersigned hereby agrees to supply the equipment as described <br />in this document’s Bid Specification. <br /> <br />6.1.D. - Page 6
