3 <br /> <br />6. NEW MATERIAL - ACCEPTANCE <br />The units herein specified shall be constructed throughout of new parts and materials, which <br />shall have seen no service other than that necessary for factory tests, unless otherwise <br />allowed in the Bid Specification. Items purchased hereunder will be subject to final inspection <br />and acceptance at delivery destination as set forth in this Notice Inviting Bids. <br /> <br />7. LOWEST RESPONSIBLE BIDDER <br />In order to promote the policy declared above, contracts will be awarded only to such Bidders <br />as are determined to meet the following qualifications of lowest responsible Bidder. <br /> <br />The award may be to the lowest responsible Bidder or other Bidder. In determining who the <br />award is to be made, the awarding authority may consider, in addition to the Submitted Bid <br />received, the experience of the Bidder for the particular service sought, the quality of work <br />that the Bidder has done, the quality of the product or materials provided by the Bidder, the <br />ability of the Bidder to complete the project in a timely manner, the safety compliance record <br />of the Bidder, and the insurance carried by the Bidder. <br /> <br />8. AWARD OF CONTRACT OR REJECTION OF BIDS <br />The City reserves the right to reject any and all proposals. <br /> <br />Whenever quantities of individual items are involved the City reserves the right to make single <br />awards or separate items in an aggregate of several items to various vendors. <br /> <br />9. GUARANTEE <br />The Bidder warrants and guarantees that all equipment, materials, vehicles or supplies used <br />or furnished and all workmanship are of the type and quality specified herein. The Bidder <br />further guarantees that any latent fault in construction or defective material discovered within <br />one year after acceptance of the work shall be remedied by Bidder without cost to the City, <br />upon written notice given to Bidder. Other subsequent latent defects shall be covered by <br />responsibilities set forth in the law. <br /> <br />In the event of failure to comply with the above-mentioned conditions within a reasonable <br />time after notice, the City will have the defects repaired and made good at the expense of the <br />Bidder, who agrees to pay the costs and charges therefore immediately upon demand. <br /> <br />The signing of this agreement by the Bidder shall constitute agreement to the above <br />guarantees. <br /> <br />10. WARRANTY <br />Bidders should specify in their Bid Submission: <br />a. Details surrounding the manufacturer’s standard warranty on all equipment. <br />b. Details surrounding any additional warranties offered on the proposed equipment. <br /> <br />11. PREPARATION FOR SHIPMENT <br />The Bidder shall prepare all articles and materials for shipment in such a manner as to protect <br />them from damage in transit, and shall be responsible for and repair all damaged parts or <br />replace all losses incurred in transit to the designated delivery point and not later than the <br />specified delivery date. When necessary, heavy parts shall be mounted on skids or crated, <br />and all articles or materials that might otherwise be lost shall be boxed or wired in bundles. <br />All articles shall be plainly marked for identification and destination. The Bidder shall prepare <br />proper commercial bills of lading 2 copies of which, together with a complete shipping list, <br />6.1.D. - Page 5
