<br /> 5. Dates and Time. The Carnival shall be held from twelve o'clock noon on <br /> July 1, 1994, and end at 10 PM on July 4, 1994. Set up time will begin at 6 <br /> PM on Thursday, June 30, 1994. The site will be cleared by 5 AM on July <br /> 5th, 1994. The Carnival shall not operate on July 4. 1994. until after 1 PM <br /> or the end of the 4th of July Parade. whichever is later. This means that <br /> neither the rides nor the qames at the carnival shall operate until after the <br /> Parade has ended. The daily "shutdown" time for the carnival will be 10 <br /> PM. This means that the rides will stop operatinq no later than 10 PM (so <br /> as to minimize the noise and inconvenience to nearby apartments). <br /> 6. Insurance: Permittee shall furnish to the City, public liability and property <br /> damage insurance naming the City of Redwood City, its council, boards, <br /> commissions, officers, employees, volunteers and agents as insureds, or <br /> additional insureds, insuring the same against all claims for personal injury <br /> or death to any person or persons resulting or arising from the conducting <br /> of the activities herein permitted, or alleged to have resulted or alleged to <br /> have arisen therefrom, or from any act or omission to act, of Permittee in <br /> connection therewith, in the amounts of $1,000,000 for each person and <br /> $1,000,000 for each occurrence, and property damage insurance for <br /> damage or injury to, or destruction of property, including the loss of use <br /> thereof, in the amount of $1,000,000. Additionally, Butler Amusement Inc., <br /> shall name the City as an additional insured on their $3,000,000 liability <br /> policy. Evidence of such insurance coverage in a form satisfactory to the <br /> City shall be furnished by the permittee to the City at least ten (10) days <br /> prior to commencement of the event. <br /> 7. Damage to Public Property. Permittee shall reimburse the City for the <br /> costs for any damages to City owned property, caused by or arising out of, <br /> the conducting of the activities permitted hereunder, or the acts, or <br /> omissions to act, of persons participating in said event. All signs or other <br /> markings placed in or upon public property, including the public right of <br /> way in connection with the activity shall be removed immediately following <br /> the event. <br /> 8. Compliance With Laws. Permittee shall comply with all appropriate and <br /> applicable rules, regulations and laws in connection with the conducting of <br /> said event, or any activities associated therewith. This permit shall be in <br /> addition to all other permits, which are or may be required for conducting <br /> said Carnival, or any activity associated therewith. Specifically, Permittee <br /> shall obtain necessary State permits and County health permits. <br /> 9. Hold Harmless. Permittee shall assume the defense of and indemnify and <br /> save harmless the City of Redwood City, its Council, officers, boards, <br /> commissions, employees and agents from all suits, actions, damages, or <br /> 2 <br /> _m ,'....-."'. <br /> i <br />
