DES:d-;k 01/04/94 (020/37) DES:d OI/10/94R WHEREAS, this Council has received extensive evidence that said building constitutes a public nuisance as defined in Section 9.6 of the Code of the City of Redwood City; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, AS FOLLOWS: 1. This Council hereby finds and determines that that certain building and appurtenances (hereinafter, "building" includes appurtenances thereto) located at 3456 Rolison Road, Redwood City, California, a former apartment complex, constitute a public nuisance as defined by certain provisions of Section 9.5 of the Code of the City of Redwood City, as follows: Redwood City Code (§9.5(a) [pertinent subdivisions referenced hereinafter] Description of Condition (11 ) Said building has been so damaged and has become so dilapidated or deteriorated to become ( i) an attractive nuisance to children; (ii) a harbor for vagrants, criminals or immoral persons; or the condition thereof enables persons to resort thereto for the purpose of committing unlawful or immoral acts; (14 ) Said building, formerly used or intended to be used for dwelling purposes, because of inadequate maintenance, dilapidation, decay, damage, faulty construction or arrangement, inadequate light, air or sanitation facilities, or otherwise, has been determined by the health officer to be unsani tary, unfit for human habitation or in such a condition that is likely to cause sickness or disease; (16 ) Said building is in such a condition as to constitute a public nuisance known to the common law or in equity jurisprudence; (17 ) Portions of said building have been I abandoned for a period in excess of six (6 ) months so as to constitute an attractive nuisance and hazard to the public. 12117 2
