<br /> DES:d-;k 01/04/94 (020/37) <br /> DES:d OI/10/94R <br /> WHEREAS, this Council has received extensive evidence that said <br />building constitutes a public nuisance as defined in Section 9.6 of <br />the Code of the City of Redwood City; <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />REDWOOD CITY, AS FOLLOWS: <br /> 1. This Council hereby finds and determines that that certain <br />building and appurtenances (hereinafter, "building" includes <br />appurtenances thereto) located at 3456 Rolison Road, Redwood City, <br />California, a former apartment complex, constitute a public nuisance <br />as defined by certain provisions of Section 9.5 of the Code of the <br />City of Redwood City, as follows: <br />Redwood City Code (§9.5(a) <br />[pertinent subdivisions <br />referenced hereinafter] Description of Condition <br /> (11 ) Said building has been so damaged and has <br /> become so dilapidated or deteriorated to <br /> become ( i) an attractive nuisance to <br /> children; (ii) a harbor for vagrants, <br /> criminals or immoral persons; or the <br /> condition thereof enables persons to resort <br /> thereto for the purpose of committing <br /> unlawful or immoral acts; <br /> (14 ) Said building, formerly used or intended to <br /> be used for dwelling purposes, because of <br /> inadequate maintenance, dilapidation, <br /> decay, damage, faulty construction or <br /> arrangement, inadequate light, air or <br /> sanitation facilities, or otherwise, has <br /> been determined by the health officer to be <br /> unsani tary, unfit for human habitation or <br /> in such a condition that is likely to cause <br /> sickness or disease; <br /> (16 ) Said building is in such a condition as to <br /> constitute a public nuisance known to the <br /> common law or in equity jurisprudence; <br /> (17 ) Portions of said building have been <br /> I <br /> abandoned for a period in excess of six (6 ) <br /> months so as to constitute an attractive <br /> nuisance and hazard to the public. <br /> 12117 <br /> 2 <br />
