DocuSign Envelope ID: 27990035-B8E8-4557-9AOD-5A1C5392E9EO <br />Attachment 2 <br />i) ABAG, its officers, officials, employees and volunteers are to be covered <br />as insureds as respects: liability arising out of work or operations <br />performed by or on behalf of the Local Project Sponsor; or automobiles <br />owned, leased, hired or borrowed by the Local Project Sponsor, <br />ii) For any claims related to this project, the Local Project Sponsor's <br />insurance coverage shall be primary insurance as respects ABAG, its <br />officers, officials, employees and volunteers. Any insurance or self- <br />insurance maintained by ABAG, its officers, officials, employees or <br />volunteers shall be excess of the Local Project Sponsor's insurance and <br />shall not contribute with it. <br />iii) Each insurance policy required by this clause shall be endorsed to state <br />that coverage shall not be canceled by either party, except afterthirty <br />(30) days' prior written notice by certified mail, return receipt requested, <br />has been given to ABAG. <br />iv) Coverage shall not extend to any indemnify coverage for the active <br />negligence of the additional insured in any case where an agreement to <br />indemnify the additional insured would be invalid under Subdivision (b) of <br />Secfion 2782 of the Civil Code. <br />e) Acceotabilitv of Insurers. Insurance is to be placed with insurers wifh a current <br />A.M. Best's rating of no less than A:VII, unless otherwise acceptable to ABAG. <br />f) Verification of Coveraae. Local Project Sponsor shall furnish the ABAG with <br />original certificates and amendatory endorsements effecting coverage <br />required by this clause. The endorsements should be on forms provided by <br />ABAG or on other than ABAG's forms provided (hose endorsements conform <br />to ABAG requirements. All certificates and endorsements are to be received <br />and approved by ABAG before work commences. ABAG reserves the right to <br />require complete, certified copies of all required insurance policies, including <br />endorsements effecting the coverage required by these specifications at any <br />time. <br />Self Insurance Option. It a Local Project Sponsor is a public entity self -insures for bodily <br />injury, personal injury and property damage liability, the Local Project Sponsor shall <br />submit written evidence of such self-insurance for approval by ABAG in lieu of <br />complying with Insurance Requirements above. Such written evidence may, but is not <br />required to, consist of a letter authorized by its chief administrative/executive officer, <br />chief financial officer, risk manager or equivalent, stating that fhe Local Project Sponsor <br />is self insured and that fhe Local Project Sponsor, has or will have, sufficient resources to <br />effect the coverage required by the Insurance Requirements. <br />DWR Prop 84 - Local Project Sponsor Agreement - IRWM 2 - Redwood City-- OWP 102244 <br />a <br />
