Item No. 2 (continued) <br />Report: Planning Director 5/15/89 <br />Exhibits submitted by Gary Dababo: <br />(1) Diagram of proposed building and surrounding buildings <br />(2) Four large color photos of property and area <br />(3) Copy of Plan Review Committee report of 3/14/89 <br />Mayor Greenalch declared the public hearing open at 7 :52 p.m. <br />Gary Dababo, 503 Nottingham Lane, Foster City, designer of proposed building <br />and brother of appellant, asked Council to uphold appeal on the grounds: <br />1) area is zoned "IR" which allows auto repair shop; 2) building needs to be <br />situated in the middle of the property to be seen from E1 Camino Real which <br />necessitates 5 of the 8 parking spaces to be in the rear of the building; <br />3) for aesthetic reasons as well as business reasons the building should not <br />be built in the rear of the property; 4) have altered building design to be <br />in compliance with Planning Department requirements (from 2 rolling doors to <br />1 rolling door and plate glass window); 5) never intended to use spaces in <br />the rear for anything other than parking; 6) will not park damaged vehicles <br />behind the building, only repaired cars, and willing to accept Use Permit <br />with conditions to that effect; 7) a one -man operation which will preclude <br />storing cars in back as there is room inside the building for 8 cars; 8) area <br />on left side of building will actually be covered driveway; 9) enforcement <br />against storage of damaged vehicles would not be a problem as surrounding <br />apartment building occupants would have view of parking area. <br />Mike Solway, 2000 San Carlos Avenue, San Carlos, spoke in favor of granting <br />appeal on grounds the parking spaces in the rear will prevent auto theft. <br />Grace Winston, owner of 2341 E1 Camino Real leased to Any Mountain, asked <br />Council to deny appeal on grounds an auto repair shop at 67 Charter Street <br />would increase parking problems in the area and would become noisy and messy <br />as other shops in the area have become. <br />In response to questions from Council Planning Director Joel Patterson <br />1) described the dangers to surrounding structures if a fire occurred in <br />the rear of the building where 5 storage spaces were located, as the only <br />access would be through the building itself; 2) described the requirement for <br />8 parking spaces and not 8 multi - purpose spaces; 3) advised locating building <br />to provide visibility to El Camino Real is not a consideration as property is <br />over 500 feet from El Camino Real on Charter Street; 4) if Use Permit granted <br />and appellant sells property in the future, City would have no control over <br />uses of property; 5) although building location set back from rear lot line <br />has merit, the problems of 8 required parking spaces with direct and <br />immediate access is still present, whereas placing building at back of lot, <br />creating all 8 spaces in front of building, providing 12 feet between <br />buildings would resolve all problems; and 6) described city policy to provide <br />most aesthetically pleasing and functional designs possible, citywide. <br />Mayor Greenalch asked if anyone else wished to speak.
