Item No. 2 (continued)
M /S: Murray /Stangel to close the public hearing.
Carried by unanimous voice vote and public hearing closed at 8:45 p.m.
City Attorney David Schricker, cited Redwood City Zoning Ordinance 1130
Section 30.15, Location of Required Parking and Loading Facilities,
illustrating required parking spaces, storage and off - street loading
facilities applicable to this Use Permit.
M /S: Claire /LaBerge to deny appeal of decision of Redwood City Zoning
Administrator to deny a Use Permit under Section 42.1, Ordinance No. 1130,
and to approve the following findings:
FINDINGS ON APPEAL FROM DECISION OF THE REDWOOD CITY ZONING ADMINISTRATOR TO
TO DENY A USE PERMIT UNDER SECTION 42.1, ORDINANCE NO. 1130 WHICH WOULD ALLOW
AN AUTO BODY SHOP WITH OUTDOOR STORAGE OF VEHICLES ON PROPERTY, 67 CHARTER
STREET, REDWOOD CITY, CALIFORNIA
Hearing having been duly noticed and held by this Council on May 15, 1989, on
the appeal of Isam Dababo ( "Appellants ") of the decision of the Zoning
Administrator to deny a Use Permit under Section 42.1, Ordinance No. 1130
which would allow an auto body shop with outdoor storage of vehicles on
property at 67 Charter Street, Appellant, Appellant's representative Gary
Dabado, Planning Director, and all other persons interested in the matter
having been heard and having been given the opportunity to be heard, and this
Council having fully considered the matter;
NOW, THEREFORE, this Council hereby finds, determines and concludes as
follows:
Granting of a use permit would be detrimental to the health, safety and
peace, morals, comfort and general welfare for the following reasons:
1. Granting of the use permit would be inconsistent with the purpose of the
"IR" Zoning District regulations as described under Zoning Ordinance Section
17.1 because outside storage of vehicles would be an offensive use of land in
the vicinity of the subject premises which includes residential purposes.
2. The proposal would provide inadequate access for emergency vehicles and
equipment to the rear of the premises which would be used or proposed to be
used for storage of vehicles.
3. The proposal as submitted provides inadquate off - street parking spaces
because the proposal includes the dual usage of both parking and vehicular
storage which is inconsistent with the interpretation of the Zoning
Ordinance.
CONCLUSION
For the foregoing reasons, the appeal should be denied, and the decision of
the Zoning Administrator affirmed, and it is so ordered.
The foregoing findings were approved by the Council of Redwood City at a
regular meeting thereof on May 15, 1989 by the following roll call vote:
Reg.Mtg.
5/15/89
MINUTE BOOK NO. 48 Page 3
Page No. 384
