(203 -10) <br />M /S: Murray /Bury to accept findings of 631 Canyon Road as follows: <br />FINDINGS ON APPEAL FROM DECISION OF THE PLANNING COMMISSION OF THE CITY OF <br />REDWOOD CITY TO DENY AN APPLICATION FOR A MINOR SUBDIVISION OF PROPERTY <br />LOCATED AT 631 CANYON ROAD, REDWOOD CITY, CALIFORNIA <br />Hearing having been duly noticed and held by this Council on May 1, <br />1989, on the appeal of James McFaden and Frank Dal Porto ( "Appellants ") of <br />the decision of the Planning commission of the City of Redwood City <br />( "Commission ") to deny Appellants' application for a minor subdivision <br />pursuant to Redwood City Code ( "RCC ") Section 30.11 for property located at <br />631 Canyon road, Redwood City ( the "Subject Property ") , Appellants' , the <br />Planning Director, and all other persons interested in the matter having been <br />heard and having been given the opportunity to be heard, and this Council <br />having fully considered the matter; <br />NOW, THEREFORE, this Council hereby finds, determines and concludes as <br />follows: <br />FINDINGS <br />1. On or about November 15, 1988, the Subdivision Committee of the City <br />of Redwood City denied Appellants' application for a minor subdivision of the <br />Subject Property on the grounds that the proposed subdivision would be <br />inconsistent with the Zoning Ordinance (Ordinance No. 1130, as amended <br />( "Zoning Ord. ") in that the proposal would create a "rear parcel" with an <br />area of less than the 10,000 square foot minimum established for parcels with <br />15% slopes (Zon. Ord. S5.6, as modified by S32.2, establishing minimum <br />building site areas for sloping sites); and also on the ground that said <br />subdivision would create a "panhandle lot" (i.e., a lot for which street <br />frontage or access width is less than the minimum required) pursuant to RCC <br />53.117 (f), the street frontage and access width of which would be 20 feet, <br />rather than the 35 -foot minimum required (id.). <br />Reg.Mtg. <br />5/15/89 <br />Page 6 MINUTE BOOK NO. 48 <br />Page No. 387 <br />
