2. Presentation of Proclamation proclaiming <br />May 22 -28, 1989 as Public Works Week (301 -04) <br />Redwood City General Services Director Fred Sennewald accepted the <br />proclamation from Mayor Greenalch and thanked the Council. <br />---------------------------------------------------------------------------- - - - - -- <br />3. PUBLIC HEARING - to rezone the property described <br />below from "GC" (General Commercial) to "IS" <br />(Interim Study) Location -- 3014, 3020, 3026, <br />3046, 3106, 3118, 3150, 3158 Rolison Road and 1251 <br />Fifth Avenue <br />Report: Planning Director 5/18/89 <br />Exhibit: Letter from Gerald M. Schneider, hand delivered May 22, 1989 <br />City Attorney David Schricker, explained the urgency ordinance submitted for <br />adoption tonight, by its very nature, does not need a public hearing nor does <br />it have notification requirements. The ordinance would be effective for <br />four months only and it would bar any use inconsistent with the proposed IR <br />zoning designation. The ordinance introduced tonight adding Section 60.5.2 <br />to Ordinance No. 1130, the Redwood City Zoning Ordinance would "permit <br />temporary review of development on the Subject Property of changing <br />conditions or development trends." (Notice of public hearing for this <br />ordinance is required to to be published and mailed and affidavits for all <br />required mailings and publications are on file in the City Clerk Department.) <br />Mayor Greenalch declared the public hearing open at 7:50 p.m. <br />Gerald M. Schneider, attorney for H. Shehadeh and for Mr. and Mrs. N. <br />Gaggero, 3118 Rolison Road, read his hand delivered letter dated May 22, 1989 <br />stating his clients did not receive adequate notice of the proposed action of <br />Council and they are entitled to the benefits of the "doctrine of equitable <br />estoppel" stating previous Planning Department actions "encouraged" Mr. <br />Shehadeh to believe he would receive a permit to open his store and to sign a <br />long -term lease. Mr. Schneider stated other businesses in the area, such as <br />roofing, are far more detrimental to health than convenience store; Mr. <br />Shehedah willing to erect fence to prevent problems in alley and to make <br />other improvements to property; and Mr. Shehedah was told he needed a Use <br />Permit when he actually only needed an architectural permit. <br />In response to questions from Council Mr. Schneider showed the lease signed <br />by Mr. Shehedah for 3118 Rolison and the receipt for the Use Permit <br />application. (Neither item was entered into the record nor were copies <br />submitted to Council or Clerk.) <br />The following citizens spoke in favor of adoption of both ordinances: <br />Ronald F.
